Defense counsel submitted [ECF No. 156] a notice of filing, and attached an affidavit and backup records. In that submission, defense counsel reserved the ability to seek additional fees and costs for time and expenses incurred after the notice of filing.Plaintiff's counsel objected to my order and filed [ECF No. 164] a motion to vacate. The motion to vacate/objection was fully briefed, and United States District Judge Joan A. Lenard entered an order [ECF No. 189] denying the motion to overrule and vacate filed by Plaintiff's counsel. If defense counsel is seeking additional fees and costs beyond the amounts sought in the initial filing, then she shall submit an additional notice of filing by February 18, 2019. That notice shall include an additional affidavit/declaration and billing records and costs documents necessary to provide backup for the fees and costs requested. Given the relationship between counsel for the parties, defense counsel need not first submit the additional fees and costs request to Plaintiff's counsel. If Plaintiff's counsel intends to object in any way to the to-be-filed notice of filing, then they shall do so by February 25, 2019.One final point:One of the Plaintiff's attorneys who is responsible for the fees and costs is no longer associated with Plaintiff's counsel's firm. Therefore, Plaintiff's counsel shall submit a copy of this Order to the formerly associated attorney by the end of business today. That attorney may file his own, separate response to any request for additional fees and costs (or he may permit current counsel to file a joint response on behalf of the firm and the formerly associated attorney -- or he may choose to not respond at all). ORDER DENYING without prejudice 140 Plaintiff's Motion for Sanctions. Plaintiff moves to sanction Defendant's counsel because Defendant's counsel has filed a 124 Motion for Sanctions against Plaintiff's counsel in this case and other cases. Plaintiff argues that Defendant's counsel's Motion for Sanctions is frivolous. Plaintiff's Motion contains no analysis, or, for that matter, a memorandum of law. Rather, it contains a single quote from a case from the Middle District of Florida which goes on for over a page. It does not explain why Defendant's counsel's Motion for Sanctions is frivolous, and there has been no finding in that regard. Accordingly, 140 Plaintiff's Motion for Sanctions is DENIED without prejudice. ORDER DENYING 102 Plaintiff's Motion for Reconsideration Regarding Order D.E. 101 . "The 'purpose of a motion for reconsideration is to correct manifest errors of law or fact or to present newly discovered evidence.'" Burger King Corp. v. Ashland Equities, Inc., 181 F. Supp. 2d 1366, 1369 (S.D. Fla. 2002) (quoting Z.K. Marine Inc. v. M/V Archigetis, 808 F. Supp. 1561, 1563 (S.D. Fla. 1992)) "In particular, there are three major grounds which justify reconsideration: (1) an intervening change in controlling law; (2) the availability of new evidence; and (3) the need to correct clear error or prevent manifest injustice." Id. (citations omitted). Upon review of the Parties' submissions, the Court finds that reconsideration is unwarranted. The Court has not made a manifest error of law or fact, and manifest injustice will not result absent reconsideration. ORDER STRIKING 99 Notice of Acceptance of Defendant's Offer of Judgment Under Rule 68 of the Federal Rules of Civil Procedure. Co., 197 F.3d 1276, 1280 ("Federal Rule 68 is inapplicable in a case in which the defendant obtains judgment.") (citing Delta Air Lines, Inc. v. August, 450 U.S. 346, 352 (1981)); La. Power & Light Co. v. Kellstrom, 50 F.3d 319, 333 (5th Cir. 1995) ("If a plaintiff takes nothing, however, Rule 68 does not apply.... the rule is not applicable when a defendant actually prevails over the plaintiff."). Accordingly, Plaintiff's Notice of Acceptance of Defendant's Offer of Judgment Under Rule 68 of the Federal Rules of Civil Procedure is STRICKEN.
