Bianco are (1) defendant Nassau Countys motion to dismiss the Complaint and defendants Hempstead Police Department and Officer Anthony Cousins (the Hempstead Defendants) cross-claims pursuant to Fed. R. Civ. P. 12(b)(6) filed March 17, 2017, see DE 32, and (2) defendants Hempstead Police Department and Officer Anthony Cousins motion for judgment on the pleadings pursuant to Fed. R. Civ. P. 12(c) filed May 22, 2017, see DE 42. However, pro se plaintiff 20E0B3D filed a motion for leave to amend the Complaint pursuant to Fed. R. Civ. P. 15 (which was entered on May 30, 2017 and referred to the undersigned), see DE 43, which may materially alter the positions taken by some of the defendants. Defendant Nassau County has not filed an opposition to plaintiffs motion. Although the Hempstead Defendants filed a letter in opposition to plaintiffs motion on the ground that plaintiff failed to specify how he intended to amend the Complaint, the Court notes that plaintiff attached a proposed amended complaint to his letter motion. See DE 43-1. It is well-established that where a plaintiff seeks to amend his Complaint while motions to dismiss are pending, the court has a variety of ways in which it may deal with the pending motion[s] to dismiss from denying the motion[s] as moot to considering the merits of the motion[s] in light of the amended complaint. Kilpakis v. JPMorgan Chase Finl Co., 229 F. Supp. 3d 133, 139 (E.D.N.Y. 2017) (citation omitted). Upon consideration of the parties positions and given the historical solicitude afforded to pro se plaintiffs, see Matima v. Celli, 228 F.3d 68, 81 (2d Cir. 2000) (Generally, leave to amend should be freely given, and a pro se litigant in particular should be afforded every reasonable opportunity to demonstrate that he has a valid claim), the undersigned GRANTS plaintiffs motion for leave to file an amended complaint. If plaintiff chooses to file an Amended Complaint, he is directed to file the Amended Complaint within thirty days of the date of this Order. The respective Defendants motions, DE 32, 42, are deemed WITHDRAWN without prejudice. Upon the filing of an Amended Complaint, the respective defendants may renew their previously-filed motions or otherwise respond to the operative pleading.
