REPORT AND RECOMMENDATIONS re 212 MOTION to Certify Class Action filed by 8FB0964, 220 MOTION to Dismiss filed by Edward Mangano, Nassau County Civil Service Commission, County of Nassau: For the reasons set forth in the attached Report and Recommendation, the Court respectfully recommends that Defendants' motion for judgment on the pleadings be denied and that Plaintiffs' motion to certify their NYLL claims as a Rule 23 class action be granted. The Court further respectfully recommends that Louis D. Stober be appointed as class counsel. Finally, the Court recommends that Plaintiffs be directed to modify the proposed notice of pendency, serve a copy of the revised proposed notice on Defendants and submit a copy to the Court for approval, after Defendants have had an opportunity to review the proposed notice and the parties have addressed any objections. Any objections must be filed with the Clerk of the Court on or before 7/30/2019. Failure to file objections within the specified time waives the right to appeal the District Court's order. DECISION AND ORDER - Based on the foregoing, the Defendants 5 motion to dismiss the complaint is granted in part and denied in part. In particular, the Court grants the portions of the motion seeking to dismiss the third cause of action based on intentional discrimination under 42 U.S.C. ยง 1983, and seeking to dismiss the complaint as against the Nassau County Civil Service Commission. However, the Court denies the portion of the motion seeking to dismiss the complaint as against County Executive Edward Mangano, and seeking to dismiss the Plaintiffs claim for unpaid overtime wages. Accordingly, the Clerk of the Court is directed to amend the official caption as further set forth herein. If, by March 6, 2017, the Plaintiffs have not filed a formal motion for leave to amend, the Defendants answer to the remaining portions of the complaint shall be due no later than March 13, 2017. SEE ATTACHED DECISION for details. So Ordered by Judge Arthur D. Spatt on 2/7/2017. Nassau County Civil Service Commission terminated. (Coleman, Laurie)
