Government's motion for early return of trial subpoenas 88 is granted. Government's consolidated motions in limine 91 are granted in part and denied in part as follows: Without objection, motion to preclude defenses of alibi or mental defect is granted. Motion to admit evidence of Defendant's efforts to conceal himself is granted; Defendant is free to argue that his conduct did not reflect consciousness of guilt. Defendant's objection to admission of bank records as business records is sustained, absent the testimony of a foundation witness. As both sides have subpoena power in this case, neither side will be permitted to make a "missing witness" argument. Investigative reports may be used to refresh recollection or to impeach the agent who prepared the report; they may not be used to impeach witnesses whose statements are recounted in such reports. Witnesses will not be asked to comment on the credibility of other witnesses (and will not be asked whether other witnesses "were lying". Evidence of potential penalties Defendant faces, if convicted, is not admissible. Parties will not comment on discovery in the presence of the jury. Non-pertinent character traits of Defendant are not admissible, but the court reserves ruling on whether other episodes or conduct of Defendant are admissible. Arguments related to nullification or to unfiled suppression motions are inadmissible. Government's motions regarding prior convictions [92, 93] are granted in part but denied with respect to admission of evidence of convictions of making a false statement to law enforcement. The court has again questioned Defendant regarding his decision to proceed pro se and concludes he has knowingly and unequivocally exercised his right to do so. ORDER as to Edward Everett Johnson: Edward Everett Johnson has been charged in a one-count indictment with robbery of the Chase Bank in Rockford, Illinois on April 20, 2016. The case was assigned to Judge Kapala in the court's Western Division but was reassigned on March 12, 2019. The court has directed the Magistrate Judge to communicate with the parties and identify the next date on which both sides are available for trial. Three motions are pending: a motion to dismiss the indictment on the basis of a violation of the Speedy Trial Act 68 ; a motion for individual voir dire of potential jurors 75 ; and a motion to dismiss the indictment for what Defendant believes is an "Apprendi violation" 76 . For the reasons explained here, the Speedy Trial motion 68 is denied. The Apprendi motion 78 is entered and continued pending possible sentencing. Defendant's motion for individual voir dire procedure 75 is granted in part and denied in part.
