With respect to the production of personal cell phone records of Defendant Police Officer Falk and non-party Det. Strange, the following directives shall be followed:Confidentiality shall be limited to attorneys' eyes only and all parties as well as non-party Nassau County shall enter into a confidentiality order establishing such forthwith.As to the method of production, any proposed subpoenas shall be made returnable to either Defense counsel, for Police Officer Falk, or The County Attorney's Office for Det. Strange, but shall remain sealed and only opened and reviewed with counsel for the respective parties reviewing them together. Any records already obtained by subpoena shall remain sealed and shall only be opened and reviewed with counsel for the respective parties reviewing the records together to find the relevant conversations. All other information shall be redacted before providing a copy to Plaintiff's counsel.As to the scope of the subpoenas, the Court denies the motions to limit the time frame to solely March 5, 2015 and March 6, 2015. Telephone records from March 5, 2015 through July 12, 2017 are relevant to Plaintiff's claim, are non-privileged and are not overly burdensome to produce. Thus, the discoverable time-frame for the referenced telephone records shall be March 5, 2015 - July 12, 2017. Further, as Plaintiff's motion for Nassau County to provide Det. O'Conner's cell phone number to Plaintiff remains unopposed, the motion is GRANTED. The number shall be provided to Plaintiff's counsel under seal and subject to the strict provisions of the confidentiality order and the directives outlined above.
