MINUTE ORDER. Upon consideration of 40 plaintiff's Motion to Substitute, it is hereby ORDERED that the motion is GRANTED. Under Federal Rule of Civil Procedure 25(a), if a party dies and the claim is not extinguished, the court may order substitution of a proper party upon the party's motion. Peter 428EFF7 is named in his father 428EFF7 will as the executor of his estate, but he has not yet been formally appointed as executor because New York proceedings are delayed due to the ongoing pandemic. Nevertheless, our Circuit and other circuits have interpreted "proper party" to include a person named in a will as the executor of the decedent's estate, even if the will has not been probated. See McSurely v. McClellan, 753 F.2d 88, 99 (D.C. Cir. 1985); In re Baycol Prods. Litig., 616 F.3d 778, 783-84 (8th Cir. 2010). Our Circuit has dispensed with the need for "unwarranted rigidity" in its interpretation of Rule 25. Rende v. Kay, 415 F.2d 983, 986 (D.C. Cir. 1969). Indeed, "a proper party need not necessarily be the appointed executor or administrator of the deceased party's estate" at all. Sinito v. DOJ, 176 F.3d 512, 516 (D.C. Cir. 1999). Defendant focuses on the Court's May 27, 2020 Minute Order, but the decision to substitute a party is a discretionary one, and the Court is in no way bound by its prior suggestion that it would substitute parties once the deceased plaintiff's son was formally appointed as the executor of his father's estate. The Court sees no reason to wait and many reasons not to, namely avoiding additional delay and expense.
