ORDER of Court regarding Distribution of Settlement Funds. The Court approves the payment of the listed amounts to the named pltfs. The Clerk is directed that the settlement funds received in this case in the amount of $275,000.00 plus interest and less the mandatory administrative handling fee be paid immediately to Timothy P. O'Brien, Esq., Administrator, for the distribution consistent with this Order. Distribution of the settlement funds shall be as follows: a. Amount agreed to and identified in the individual releases already provided to defts, shall be paid to pltfs except as provided in Paragraph 2.b infra. b. ORDER that pltf's counsel, Timothy O'Brien, is appointed as administrator of the Fund. Mr. O'Brien is to be responsible for obtaining an employer identification number for the fund, the filing of all fiduciary tax returns and the payment of any tax. The Clerk shall deposit the said Fund into the Registry of the Court as a settlement fund. As soon as the business of the office allows, the Clerk shall deposit the money into an interest-bearing account by delivering a check in the amount of $275,000.00 to PNC Bank for deposit into a Business Premium Money Market Account at the rate then obtaining. In return, the Clerk is to receive an indicia of ownership showing the account title which shall read: United States District Court for the Western District of Pennsylvania Clerk of Court, Registry Account for Settlement Fund Civil Action No. 96-560. The depository, PNC Bank, shall continue to maintain the account until further order of the Court and shall pay to the Court a percentage of all interest earned to satisfy a handling fee set by the Judicial Conference. All other defts, together with the organizational pltfs are hereby dismissed from this action. The following cause of action in pltf's Third Amended Complaint are hereby dismissed, with prejudice: a. Fourth Cause of Action: "The incarceration of pltfs without probable cause violates the Due Process Clause of the Fourteenth Amendment to the U.S. Constitution;" b. Sixth Cause of Action: "The search, seizure, arrest and malicious prosecution of, as well as the use of excessive force against, African-Americans because of their race violates 42 U.S.C. Section 2000d;" and c. Any claim of a violation of substantive due process under the Fourteenth Amendment to the U.S. Constitution.
