On 1/30/18 this Court ordered Mr. 9C9C60F to respond to certain discovery by 2/12/18. 169 The Court limited the number of requests Mr. 9C9C60F was required to respond to and limited the time frame of those requests (10/1/17-1/30/18). With these limitations, the Court believes any burden has been addressed and therefore overrules 9C9C60F burdensome objections. Defendant responded, based on relevance, that all of the requests should be limited to the allegations here: (1) any investment by 9C9C60F in Capital; and (2) any alleged solicitation of Zach Hughes by 9C9C60F. Under the circumstances, the fact that 9C9C60F had brunch with a current employee of AGH and that, according to Mr. 9C9C60F affidavit, he discussed investing in Capital and employing Zack, albeit according to his affidavit, in a completely hypothetical way, AGH has established a basis to conduct discovery into whether 9C9C60F has breached the Settlement Agreement. The Court therefore overrules 9C9C60F relevance objection. Interrogatory 1 had been answered. Interrogatories 2 and 3 seek communications with the owner of Capital or about Capital. Interrogatories 4 and 5 seek communications with vendors, employees, independent contractors, agents, or marketing representative of AGH. These Interrogatories are relevant to the inquiry about whether Mr. 9C9C60F violated the Settlement Agreement. However, the Court narrows Interrogatory 4 such that 9C9C60F does not need to provide information on contact with "former vendor, employee, or independent contractor." 9C9C60F need not provide any further response to Interrogatory number 6. 9C9C60F objections to the Request for Production are overruled. Documents being withheld must be produced, including documents being withheld that are responsive to Request to Produce number 8. As to the telephone records requested in Request to Produce Number 7, those records shall be produced to a third-party vendor. The Vendor shall redact all strictly personal numbers from the records prior to providing the names of persons called to counsel for both parties. Mr. 9C9C60F shall provide discovery by 3/19/18. The Court specifically noted on the record at the conclusion of the settlement conference that the holdback, as well as subsequent year payments, would be the "subject of a promissory note." (Tr. at 3). No escrow was contemplated or is warranted. As to the "significant dealers," this term was not defined during the discussions and is precisely the type of term better left to parties to resolve. Based on the size of the potential market of auto dealers and the amount of money being paid for shares as well as for non-competition/non- solicitation, a list of 812 clearly defined entities strikes the Court as reasonable. AGH's Motion to Quash and for Protective Order [97 and 99] is ruled on as follows: (1) The court finds that AGH has standing to challenge the subpoenaed documents as the documents involved are AGH financial documents and business records. "A party has standing to move to quash a subpoena addressed to another if the subpoena infringes upon the movant's legitimate interests." United States v. Raineri, 670 F.2d 702, 712 (7th Cir. 1982). "Specifically, a non-recipient can object when she has a claim of privilege or when the subpoena implicates her privacy interests," including the release of financial information. See, e.g., HTG Capital Partners, LLC v. Doe(s), No. 15 C 02129, 2015 U.S. Dist. LEXIS 126358, 2015 WL 5611333, at *3 (N.D. Ill. Sept. 22, 2015). (2) As to the subpoenas issued to the two potential purchasers ("G" and "S"), by 5/26/17, AGH shall provide a list of categories of documents that it provided to the potential purchasers and identify those categories that AGH objects to producing, one category will be communications with the purchaser. If the parties cannot agree on any of the categories, they can submit a joint document to the Court indicating the categories of disagreement and the Court will rule whether or not those categories will be included in the subpoenas. AGH was to produce those lists by 3/24/17. Plaintiffs assert that AGH served interrogatory responses identifying thousands of "exemplary documents supportive of" AGH's claims. As to proving that Plaintiffs misappropriated customer lists, AGH is limited to the documents identified in response to RFP 43 as of today's date. Rowland: Status hearing held and continued to 3/16/17 at 9:45 a.m. On 1/26/17 the Court adopted the parties' discovery plan requiring all fact discovery to be completed by 5/5/17 29 . That was an agreed schedule and an expedited one. At the time Plaintiff had been terminated by defendants. Plaintiff has since been rehired. In the four weeks that have passed, the parties have been unable to agree on a deposition schedule. The parties are at odds over when to set a Rule 30(b)(6) deposition and when to depose the President of AGH, Inc. The deposition scheduling dispute led to the filing of Defendant's Motion for Protective Order 50 and Plaintiffs' Motion for Status 45 . Having heard the parties argue, the court has determined that getting the discovery completed on such an expedited schedule is not productive. Neither party could articulate any prejudice that would arise from extending the schedule, and the inability of the parties to resolve even the simplest of tasks (agreeing on a deposition schedule) illustrates that this schedule is unworkable and does not promote judicial efficiency. The court doubts it serves the interests of the parties to conduct depositions on such a rushed schedule. Therefore, the court revises the parties' agreed schedule, sua sponte, as follows: no oral discovery is to begin until 3/20/17, all fact discovery is to be completed by 7/7/17 [NOTE CHANGE]. Parties' Rule 26(a)(2) disclosures and reports shall be served by 7/14/17; parties' rebuttal expert reports shall be served by 8/11/17. All expert discovery shall be completed by 9/1/17. All dispositive and Daubert motions with supporting memoranda shall be filed by 9/15/17; responses due 10/6/17. Defendants' motion for protective order 50 is granted consistent with this order. By the next status the parties are to have an agreed deposition schedule. Going forward, any time either party makes a written request for a meet and confer regarding discovery objections, the responding party is to conduct that meet and confer within 48 hours of the written request.
