	Minute Entry for proceedings held before Magistrate Judge James Orenstein:Status Conference held on 4/29/2010. SCHEDULING: (1) There are no further proceedings scheduled before me in 09-CV-4132. (2) The next pretrial conference in 10-CV-1677 will be held on July 12, 2010, at 9:30 a.m. THE FOLLOWING RULINGS WERE MADE: The appearing parties acknowledged that the case in 09-CV-4132 ("the 2009 Case") was dismissed, and the Complaint in 10-CV-1677 (the "2010 Case") then filed, to allow the plaintiff to avoid the unwanted effect of my order requiring any party in the 2009 Case seeking to amend a pleading or add a new party to satisfy not only the requirements of Fed. R. Civ. P. 15, but also to show good cause for the untimely action under Fed. R. Civ. P. 16. See 2009 Case, Order dated February 15, 2010. The plaintiff sought neither reconsideration of that ruling pursuant to Loc. Civ. R. 6.3, nor review by the assigned district judge pursuant to Fed. R. Civ. P. 72. Rather than allow the parties to evade a valid ruling in that manner, I ordered the following: (a) The schedule in the 2010 Case for the completion of all pretrial proceedings as to the plaintiff's claims against defendant Dorfman (assuming that the plaintiff serves the new Complaint on that defendant and that there is an answer) will match the schedule for such proceedings set forth in the Amended Case Management and Scheduling Order in the earlier action. See 2009 Case, docket entry 12. I will enter a separate order to that effect. (b) To the extent that the plaintiff serves process on any other defendant in the 2010 Case and such defendant appears, I will bifurcate all pretrial proceedings on the claims against those defendants pending the resolution of the claims against defendant Dorfman.
