ORDER granting in part and denying in part 171 Letter Motion for Discovery. The Court adopts the Plaintiff's proposed language that defines Confidential information as information "whose public release would violate common law and statutory privacy interests...." The Court further adopts the Defendants' proposed language that defines Confidential information to include information reflecting "sexual activity or sexual contact," or "any information subject to N.Y. Civil Rights Law §§ 50 or 51, or any other information deemed private by a Court of competent jurisdiction to include the tort of publication of private facts." The Court denies the Plaintiff's request to include as confidential "copyrighted or trademarked materials." The parties are reminded that this Protective Order is primarily for the purpose of disclosures among the parties. The fact that the parties have determined that particular information is Confidential under a Protective Order, does not mean that it will be filed under seal when submitted to the Court for purposes of a judicial determination. Rather, the party seeking to file something under seal will need to address the test set forth in Lugosch v. Pyramid Co. of Onondaga, 435 F.3d 110 (2d Cir. 2006). Accordingly, pursuant to Rule 26(c) of the Federal Rules of Civil Procedure, good cause having been shown, the parties are ORDERED to prepare a proposed Protective Order consistent with the Court's rulings and to submit it to the Court no later than November 27, 2018.
