MINUTE ORDER IN CHAMBERS by Judge S. James Otero: In light of the Supreme Court's granting of certiorari and narrowing of the two nationwide injunctions, this Court invites the parties to submit a joint status report on orbefore July 6, 2017 that addresses the following issues. First, does either side believe that any putative class members located abroad "lack any bona fide relationship with a person or entity in the United States"? If so, the party so claiming must identify by name any such putative class members and provide its rationale for holding such a belief. Second, should the Court exercise its discretion to stay these proceedings pending the Supreme Court's decision in IRAP regarding the merits of constitutional and statutory challengesto EO-2, which can be expected either in late 2017 or early 2018? See CMAX, Inc. v. Hall, 300 F.2d 265, 268 (9th Cir. 1962) ("A district court has inherent power to control the disposition of the causes on its docket in a manner which will promote economy of time and effort for itself, for counsel, and for litigants. The exertion of this power calls for the exercise of a sound discretion."). That the Court is contemplating staying these proceedings pending the Supreme Court's decision in IRAP should not encourage the Government to delay the timely processing of valid immigrant visa applications initiated by submitting Form I-130 Petitions. Indeed, the Supreme Court has instructed the Government not to enforce EO-2 against foreign nationals who have a "bona fide relationship with a person or entity in the United States," which would include a Yemeni beneficiary of a validly submitted Form I-130 Petition by a relative who is either a U.S. citizen or a lawful permanent resident. The Court encourages Plaintiffs and the Government to work together to expeditiously and in good faith process visa applications submitted on behalf of the Yemeni beneficiaries identified in the SAC and Motion. MINUTES OF Status Conference held before Judge S. James Otero: The Court held a status conference on February 21, 2017 during which it heard argument from counsel regarding (1) Plaintiffs' filing of a First Amended Complaint; (2) Plaintiffs' filing of a Motion for Class Certification; and (3) the parties' respective views concerning whether the Temporary Restraining Order("TRO") issued on January 31, 2017 should be extended, modified, dissolved, or converted into a preliminary injunction. After hearing from the parties and taking two recesses, the Court found that Plaintiffs had not succeeded in demonstrating good cause for extending the TRO or converting the TROinto a preliminary injunction with the same scope as the TRO. In particular, the Court found that Plaintiffs had not demonstrated that any irreparable harm would occur in the event the TRO were dissolved given the existence of the nationwide temporary restraining order issued by Judge Robart in State of Washington v. Trump et al., No. 17-CV-00141-JLR (W.D. Wash.) and given Plaintiffs' counsel's inability to identify any named plaintiffs with validly issued immigrant visas who were currently being denied the ability to immigrate to the United States.
