MINUTE ORDER granting 71 BILL OF COSTS. On December 18, 2019, the Court entered its Final Judgement in favor of defendants, the District of Columbia and Corrections Corporation of America; and against plaintiff, 6C4952C. ECF No. 69. Defendant Corrections Corporation of America filed its Bill of Costs on January 8, 2020. ECF No. 71.Plaintiff objects to Defendant's bill of costs, arguing that (1) "Plaintiff is unable to work, without income and would be unable to pay any amount imposed as cost," ECF No. 73 at 1; (2) Plaintiff continues to suffer from the trauma stemming from the incidents that led to the litigation and the case was not frivolous, see id. at 2; (3) since Defendants "unilaterally" removed this case from the Superior Court of the District of Columbia, "removal related costs should be denied," id.; (4) all "printing and copying for disclosure related costs should be denied" because Defendant "had discovery obligations to disclose all documents within their possession and control... [and] cannot turn around and claim costs as a result of complying with that discovery obligation," id. at 3; (5) Attorney Timothy Ray's "inclusion in the case, when there were other competent attorneys already in the case was meaningless... [and] [a]ll costs related to [his] appearance should be denied," id; (6) "the videoing of the deposition of the plaintiff in the case... was... unnecessary and wasteful... [and] [a]ll depositions related costs should be denied," id.; and (7) "depositions and copying and printing related costs should be denied" because they were "not used at any hearing or trial in this case," id. at 3-4.Defendant replies that (1) Plaintiff "has not met her burden of showing circumstances sufficient to overcome the presumption of awarding costs to Defendants" and the Court should "require substantial documentation of a true inability to pay," ECF No. 74 at 2; (2) the fee for removing the case to this Court is recoverable because "Plaintiff agreed to the removal" and it is a "statutorily required fee imposed by the clerk," id. at 3-4; (3) Defendants are "entitled to its fees for obtaining documents related to Plaintiff" and notes that "records were obtained in 2014, two years before Plaintiff filed a lawsuit and three years before CoreCivic agreed to defend and indemnify the District," id. at 4; (4) since Defendant CoreCivic bore the cost of the pro hac vice filing fee to defend itself in this District," it is entitled to recoup the fee, id. at 5; and (5) "Defendant is also entitled to recover its deposition costs" because the "deposition in support of its Motion for Summary Judgment" and videography, which was taken during the deposition, "would have been necessary to prepare for trial and for potential use for impeachment," id. at 5-6.Litigation "costs... should be allowed to the prevailing party." Fed. R. Civ. P. 54(d); see also McGovern v. George Washington Univ., 326 F.R.D. 354, 355 (D.D.C. 2018) (quoting Delta Air Lines, Inc. v. August, 450 U.S. 346, 352 (1981)) ("[L]iability for costs is a normal incident of defeat.").Pursuant to 28 U.S.C. ยง 1920, the Court "may tax as costs", inter alia, "(1) [f]ees of the clerk and marshal; (2) [f]ees for printed or electronically recorded transcripts necessarily obtained for use in the case; (3) Fees and disbursements for printing and witnesses; [and] (4) Fees for exemplification and the costs of making copies of any materials where the copies are necessarily obtained for use in the case." "Although costs are generally awarded as a matter of course, the district court has discretion in allowing, disallowing, or apportioning costs." Guevara v. Onyewu, 943 F. Supp. 2d 192, 195 (D.D.C. 2013) (internal citation omitted). "However, 'a court may neither deny nor reduce a prevailing party's request for costs without first articulating some good reason for doing so.'" Id. (quoting Baez v. U.S. Dep't of Justice, 684 F.2d 999, 1004 (D.C.Cir.1982))."In accordance with the presumption that costs are awarded to the prevailing party, federal courts have placed on the unsuccessful parties some burden of showing circumstances sufficient to overcome the presumption favoring the prevailing party." Guevara, 943 F. Supp. 2d at 19596 (internal citation and quotation marks omitted).The Court concludes that the requested costs are recoverable because the items were "necessarily obtained... for use in the case" and thus will award those costs as requested. McGovern., 326 F.R.D.at 356 (internal citation and quotation omitted). As Defendants note-and the Court agrees-Plaintiff fails "to meet her burden of showing [her financial] circumstances... overcome the presumption of awarding costs to the prevailing party." ECF No. 74 at 3. Indeed, Plaintiff provides no documentation of her financial status, was not proceeding in forma pauperis in this case, and does not cite even one case supporting any of her arguments. MINUTE ORDER. In view of the parties' joint status report in which the District of Columbia, CoreCivic, and plaintiff consented to the referral of this case to a magistrate judge for purposes of settlement, the Court hereby refers these parties to Magistrate Judge Harvey for purposes of settlement. Defendant Unity Health Care Inc. is directed to file a notice indicating whether it consents to participate in a settlement conference with Magistrate Judge Harvey by no later than November 17, 2017. If the parties decide to settle either in whole or in part, the parties shall inform the Court by filing a stipulation of dismissal. If the parties decide not to settle, the parties are directed to file a further joint status report as soon as practicable but in any case by no later than February 5, 2018 with a recommendation for further proceedings.
