ORDER : Federal Defender's motion to withdraw from representation and request for the appointment of substitute counsel 109 is granted. Representation of Jill M. Skwor and the Federal Defender Program is withdrawn. The court's order granting defendant's motion to voluntarily withdraw his motion for compassionate release 105 is vacated and defendant's pro se motion for compassionate release 98 is reinstated. Defendant has brought his motion for compassionate release under 18 U.S.C. § 3582(c)(1)(A), as amended by the First Step Act (First Step Act of 2018, P.L. 115-391, S. 603(b), 132 Stat. 5194). The court appoints Criminal Justice Act counsel Brendan W. Caver, Law Officers of Brendan W. Caver, Ltd., 308 W. State Street, Rockford, IL, for the limited purpose of representing defendant in this matter. Counsel Caver is entitled to a copy of defendant's original presentence investigation report from the United States Probation Office. Counsel shall file a supplement to defendant's motion or status report with the court. Counsel is reminded that under the amended statute, a defendant may now motion the court for a compassionate release after a "defendant has fully exhausted all administrative rights to appeal a failure of the Bureau of Prisons to bring a motion on the defendant's behalf or the lapse of 30 days from the receipt of such a request by the warden of the defendant's facility." 18 U.S.C. § 3582(c)(1)(A). The court expects counsel will address this requirement in the supplemental motion or status report. The court notes defendant has attached some medical documentation to his motion [98-1]. Because of the medical circumstances alleged by defendant in his motion, and in light of the COVID-19 health concerns in prisons, the court sets a short briefing schedule.
