MINUTE ENTRY for proceedings held before Magistrate Judge Diana Song Quiroga. INITIAL PRETRIAL & SCHEDULING CONFERENCE held on 5/5/2017. The Parties appeared telephonically: Plaintiff through counsel James Ryan Fowler, Defendant through counsel Vanessa Annette Rosa. The Court reviewed the procedural history of the case and inquired as to Mr. Fowler's status as an attorney of record in this case. Mr. Fowler advised that he had filed a Notice of Appearance (Dkt. No. 3), and the Court noted that Mr. Fowler did not appear at the top of the docket and would correct the omission. Turning to the case, the Parties advised that they will notify the Court if they intend to file dispositive motions. The Court explained the different scheduling tracks depending on whether dispositive motions are filed. The Court also inquired as to the possibility of appraisal in this type of litigation. Mr. Fowler advised that the contract does include an appraisal clause, but that the Plaintiff would prefer to explore mediation before invoking appraisal. Ms. Rosa said she would have to discuss appraisal with her client, but assured the Court that if Defendants invoke appraisal, it would be in the early stages of the litigation. The Parties agreed to a proposed June 30, 2017 date for motions to stay the litigation if appraisal is invoked, which will be reflected in the scheduling order. Turning to the remaining deadlines, the Parties agreed that the proposed dates remain viable. The Court then reviewed the Local Rules and reminded the Parties that the filing of a discovery motion does not stay the relevant discovery deadlines while the motion is pending. Furthermore, stipulations as to deadline extensions are not binding on the Court, and any requests for continuances must be timely filed and demonstrate good cause. All discovery requests must be timely served, and any discovery request that is served so that the regular deadline for responding falls after the close of discovery is not timely served. The Court also advised the Parties of their duties to confer prior to filing motions and reminded the Parties that the Court believes most, if not all, discovery conflicts can generally be resolved through meaningful conferrals prior to requesting court involvement. The Court then advised the Parties of the implications of filing their joint pretrial documents and advised the Parties to only file once they are fully prepared for trial. Finally, the Court summarized the Conference, and advised the Parties that the Court will enter a formal scheduling order memorializing the agreed scheduling deadlines.
