Minute entry - Hearing held before Judge J. Thomas Greene: The Court notes Judge Bruce S. Jenkins has requested Judge J. Thomas Greene to step in and overlook the settlement conference. The Court notes there will not be a court reporter in the settlement proceedings. Pla's cnsl will send Chou Chou Collins a notice of her being removed from the mailing list, since cnsl states she is no longer involved in the case. If she objects to the removal of her name, cnsl will inform the Court. The Court has read Judge Jenkins' opinion and considers it law in the case. Cnsl are instructed to file, under seal, a settlement conference statement. The settlement conference statement shall contain undisputed matters, brief statement of major issues of dispute, relief sought, statement of costs and litigation costs to this point, any prior settlement discussion, and any discreet issues that would prioritize the discussion and anything would aid in the disposition of the case. As cnsl agrees, ptys will be available at all times for discussions and/or have ptys present who can bind to the disposition of the case. Cnsl will file statement by 8/18/99, 7 days prior to the conference. Cnsl will deliver statement to chambers, not to the Clerk of the Court. The Court will send out an an order, substituting paragraph 5 in the order cnsl previously received, with the information given , and stated above. Cnsl indicates one day should be sufficient for settlement discussions. The Court sets 8/25/99 at 9:00 a.m. and will continue through the day, as needed. Cnsl are instructed to meet in chambers Room 447. Mr. Wilcox indicates Mr. Ross Anderson will not be able to attend settlement conference, and both ptys stipulate to excuse his absence. Minute entry: This matter came before the Ct for hearing on motions for protective order; motions to quash and motion to strike. Ct granted the motion to strike. As to the mots for protective order and to quash, the court ruled that the plaintiff is entitled to discovery regarding the contents of any disciplinary action taken against def Jeffs by the Dept of Corrections. The prod/of said docs shall be for the limited use and review of the parties their counsel and retained experts only. The docs shall not be released to any person other than the parties, retained experts, cnsl of record and their legal support staff, and to the Ct under seal, until further order of the court. Further the pla is entitled to disc regarding the contents of any disciplinary action taken against def Jeffs by the Dept of Corrections. The ptys agree that the prod of said documents shall be for the limited use and review of the ptys, their cnsl and retain experts only. The docs shall not be released to any person other than the parties, retained experts, cnsl of record and their legal support staff, and to the Court under seal, until further order of the Court. The Dept of Corrections, by and through cnsl, Chou Chou Collins, Asst Atty Gen, hereby joins in the jt motion and stip of the ptys for a protective order regarding the contents of any disciplinary action taken against Jeffs by the Dept. It was agreed in open court that the STate will provide the names of every person the governor talked to - give them a roster of names and addresses of each person the governor conversed with concerning the incident - not what they said - no conversations needed with respect to the spouse and allow cnsl to depose the persons identified. The Court quashed the subpoenas subject to their being revised and conditioned upon the roster which will be provided. Cnsl may depose those people starting 10/24/97 which will take approx 10 days. The roster is to be fld with the clerk by 10/24/97. Any medical records of other inmates can be reviewed by Mr. Anderson. Information with respect to the "chair" is to be furnished not later than 12/19/97. Ptys to get together and discuss how long it will take to produce the docs. Mots/dismiss and mots/limine - responses are to be filed on or before 10/23/97. Mr. Anderson will prepare and submit an order reflecting discussion heard to day with respect to prod/docs, etc. Judge: Bruce S.
