ORAL ORDER: The Court, having reviewed Plaintiffs Motion to Lift Stay (Motion), and the briefing related thereto, (D.I. 269; D.I. 270; D.I. 271), hereby ORDERS that the Motion is GRANTED and the case should resume as to asserted claim 6 of the '058 patent (claim 6). After considering the three stay-related factors, as well as recent changed circumstances that impact the previously-imposed stay, the Court concludes that this outcome is appropriate because: (1) The Patent Trial and Appeal Board (PTAB) has issued a Final Written Decision finding that Defendant has not shown that claim 6 is unpatentable. Although Defendant is appealing this decision, the most likely outcome of that appeal will be that claim 6 will survive. (D.I. 269 at 1); see also Elm 3DS Innovations, LLC v. Samsung Elecs. Co., Ltd., Civil Action No. 14-1430-LPS-CJB, 2018 WL 1061370, at *2 (D. Del. Feb. 26, 2018).; (2) The Court understands that there are scenarios in which, if the stay is now lifted and the Federal Circuit vacates or reverses the PTABs decision as to claim 6 (or as to claims of other patents-in-suit that the PTAB has found unpatentable), that could complicate matters in this case. "But those are complications that (if they come to pass) Defendant[] will have to live with, having taken [its] best shot at the PTAB and lost[]" as to claim 6. Id.; see also Realtime Data LLC v. Hewlett Packard Entm't. Co., CIVIL ACTION NO. 6:16-CV-00086-RWS, 2018 WL 3608544, at *3 (E.D. Tex. July 7, 2018). Defendant chose to litigate in two fora; to the extent it worries about the future possibility of two trials, (D.I. 270 at 3), that is a potential outcome that Defendant bears some responsibility for, having decided to litigate in the PTAB.; and (3) The case has been pending in the federal court system for nearly three years. While the Court is not suggesting that this delay is all Defendants fault, at some point, Plaintiffs are right to argue that they will be prejudiced if they cannot press forward in a timely fashion. See Elm 3DS, 2018 WL 1061370, at *2; LG Elecs., Inc. v. Toshiba Samsung Storage Tech. Korea Corp., Civil Action No. 12-1063-LPS-CJB, 2015 WL 8674901, at *4-7 (D. Del. Dec. 11, 2015).
