ORDER granting 2 Motion for TRO; that all defndants are enjoined and restrained from taking any action to withdraw, spoil, waste, spend, divert, transfer, move or otherwise possess the $92,541.54 distribution of loans proceeds as described in paragraphs 18 and 19 of the Verified Complaint located in account 0005155028841 at the BB&T Bank, or anywhere that such distribution may now be located; that the assets in the account 000515502881 at the BB&T Bank, up to and including the full amount of the distribution in the Verified Complaint, or an amount not less than $92,541.54, ares to be frozen and not further and not further disbursed, withdrawn, wasted or otherwise disposed of except as a refund to the Plaintiff; that the assets of the RTE Title, LLC known as "the Balance" described in the Verified Complaint, or an amount not less than $596,953.46, are to be frozen and not further disbursed, withdrawn, wasted or otherwise disposed of except as a refund to the Plaintiff; that this Order shall be binding upon all Defendants, their officers, agents, servants, employees, and attorneys, and upon those persons in active concert of participation with them who receive actual notice of the Order by personal service or otherwise; that this order shall issue upon the Plaintiff's giving of security of $1,000.00 in the form of a surety bond or a check payable to the Clerk of the Court for the payment of costs and damages as may be incurred or suffered by any party who is found to have been wrongfully enjoined or restrained; that in the event that the Plaintiff gives security in the form of a check, the Clerk of the Court is AUTHORIZED and DIRECTED to deposit into the Registry of the Court the sum of $1,000.00; that this Order shall continue unless terminated by the Court by subsequent Order, and shall expire on its own terms at midnight on May 21, 2007 unless extended by the Court through preliminary injunction; and that a hearing on the Plaintiff's request for a preliminary injunction whall be held at 3:00 p.m. on May 21, 2007 before Judge Peter J.
