ORDER granting 26 Motion for Extension of Time to 6/27/19/19 to Complete Discovery. I have carefully reviewed the parties' submissions and listened to their arguments and find that the government has demonstrated sufficient diligence to warrant an extension of the discovery deadline. Defendants do not dispute the volume of records, including some 17 million documents and 77,000 audio tapes, or the complexity of this case. The volume of the discovery, the importance of the issues at stake for both sides, and the well-established preference in this Circuit for deciding cases on their merits all support plaintiff's application. At the last conference and in his letter, plaintiff's counsel identified some 12 witnesses whom he wishes to depose, including four from Wells Fargo that he recently discovered. Those 12 depositions are the presumptive limit; however, if in the course of discovery plaintiff's counsel locates additional witnesses with relevant and material information who can be deposed before the discovery deadline, he is not precluded from seeking the court's leave to do so.
