ORDER finding as moot in part and denying in part 202 Motion to Quash by A6746F3, Aleksandr Gulkarov. Motion to quash subpoena for documents is moot. On the record with consent of Plaintiffs, counsel for Mr. A6746F3 and Mr. Gulkarov agreed to produce: (i) hard copy records in their possession relating to the named Defendants; and (ii) e-mail communications between the named Defendants and Mr. A6746F3 and Mr. Gulkarov. Plaintiffs agreed to withdraw the remaining document requests in the subpoenas. Plaintiffs also agreed to pay reasonable fees and costs associated with the production of the e-mail communications. Counsel are to inform the Court should they fail to agree upon the amount of reasonable fees and costs to be paid by Plaintiffs. Motion to quash subpoena for deposition testimony is denied. Plaintiffs have successfully demonstrated that the testimony of Mr. A6746F3 and Mr. Gulkarov would be relevant to the claims and defenses in this action, particularly as to the operation at the alleged new RICO conspirator defendants' businesses. The depositions are to take place on a date and time mutually convenient for the parties, but no later than 4/30/2020. The depositions are limited to two hours for each witness, as set forth in this Court's order of 1/30/2020 granting 218 motion to take depositions. The Court will not limit the scope of the questions to be asked at the depositions, but Plaintiffs' counsel is encouraged to use the limited time efficiently. No additional time will be permitted absent good cause shown. Ordered by Magistrate Judge Vera M. Scanlon on 2/19/2020. (Chean, Jasmine)

SCHEDULING ORDER: As to the motion at 199 (opposition at 204 ) to quash the subpoena for records of LL Consulting Group, Inc. and Keepers for You Corp, on 2/13/2020 at 3:15 PM or as soon thereafter as counsel may be heard, the Court will hear oral argument. Counsel should be prepared to discuss, among other things, why this request is not barred by the Court's scheduling order at 62 ; any concerns about burdensomeness to the nonparties, including concerns about the period for which records are requested; whether any production should be limited to State-Farm-related prescriptions; whether it is possible for the Citibank records to be limited in their production by subject matter (e.g., payor, payee, etc.), and whether State Farm should pay for the costs of any production. The request for production by Citibank of these two entities' records is stayed pending the outcome of this motion. If the records have been produced, they should be segregated and not reviewed until the motion is decided. They may not be used in anyway in this litigation until and if this motion is decided in Plaintiffs' favor. Plaintiffs are to mail a copy of this Order to Citibank and file proof of service by 1/30/2020. Ordered by Magistrate Judge Vera M. Scanlon on 1/24/2020. (Quinlan, Krista)

SCHEDULING ORDER: On 2/13/2020, at 3:00 PM or as soon thereafter as counsel may be heard, the Court will hear oral argument on Plaintiffs' motion at 205 requesting the "PrimeRx Data." Counsel should be prepared to explain why the request does not contravene the Courts previous Order limiting the time allotted for discovery from the original defendants, which was appealed and affirmed; why a search of claims records in Plaintiffs' possession does not provide sufficient information about the compounded products, the prescribers, the timing of orders, and costs; why the all of the reports themselves need to be produced rather than testimony about the frequency or inclusion of the 25% notations; why State Farm should be granted any access to non-State Farm insureds information; why State Farm should be granted access to information about non-compounded product prescriptions; whether a limitation on the production to financial information about State Farm-insureds' prescriptions would provide the motive-related evidence that Plaintiffs seek, see page 4 of letter at 205 . ORDER granting 218 Motion to Take Deposition from Soman, Chumacerio, Paul, Dovlatyan and Duhamel, Jimenez, LoDuca, Gulkarov, A6746F3, 1AD0E3D, Coles, A. Khaimov and B. Khaimov, Medisca and Williams. All defendants may be deposed each for one 7-hour deposition unless the party witnesses agree otherwise as to his, her or its deposition. As to Deponents Soman, Chumacerio, Paul, Dovlatyan and Duhamel, the depositions are each limited to three hours. As to deponents Jimenez, LoDuca, Gulkarov, A6746F3, 1AD0E3D, Coles, A. Khaimov and B. Khaimov, the depositions are limited to two hours unless the witnesses agree otherwise with regard to his or her own deposition. As to Medisca and Williams, the depositions are each limited to four hours. Based on the current record and explanations for why these depositions should be permitted, including [218-1], any longer depositions would be unduly burdensome for the defendants, and plaintiffs have not established that full-day depositions are needed. Counsel are to coordinate the dates, times and locations to minimize the inconvenience to the witnesses. Ordered by Magistrate Judge Vera M. Scanlon on 1/23/2020. (Quinlan, Krista)
