ORDER FOR STAY OF PROCEEDINGS - The Court having considered the pleadings, docket, and the application by defendant Kantor in support of this stay and the CFTC's Response to the Motion for a Stay, and the Court being fully advised in the premises, IT IS THEREFORE ORDERED THAT: 1. This matter is stayed and administratively closed with leave to reopen within 45 days after Defendant Kantor enters a plea or there is a verdict at the trial of his related criminal case, USA v. Kantor, 18-CR-177-SJF-GRB, but in no event later than 5/10/2019. 2. Kantor will notify the Plaintiff within 7 days after the entry of his plea or trial verdict is obtained in his related criminal action. 3. The CFTC shall be permitted to continue to receive and review documents obtained from third party subpoenas already issued, or that will be issued prior to the entry of this stay order, pursuant to this Court's Order granting expedited discovery DE 10 . 4. The CFTC shall be permitted to file a Motion seeking this Court's assistance through a Request for International Judicial Assistance to obtain records from the Bank of Nevis in Turks and Caicos for the Blue Bit Analytics, Ltd. account. 5. The CFTC shall be permitted to issue a survey to Blue Bit Banc investors to verify their investments with the Defendants. 6. The asset freeze shall stay in place pending a final resolution of this civil case, however, the CFTC shall be permitted to submit a proposed modified freeze order to the Court or to file a motion with the Court to resolve any issues related to a modification of the asset freeze. 7. The stay does not prevent the Commission from using third-party discovery to determine whether Defendants are violating any of the terms of the PI Order or to determine the extent of such violations. 8. If the Commission discovers that any of the Defendants is/are violating any of the terms of the PI Order, the stay does not prevent the Commission from seeking appropriate sanctions for any such violations. 9. The stay does not prevent the parties from filing papers that attempt to settle all or a portion of this action. 10. The entry of the stay of Proceedings does not preclude the entry of a default against those parties not appearing and joining in Kantor's motion. 11. During the stay, the PI Order remains in full force and effect until further order of the Court and the Court shall retain jurisdiction over this action to ensure compliance with the PI Order and for all other purposes related to this action.
