ORDER denying 162 Motion to Reopen: The Court emphatically denies the motion. First, the Court is confident that the reasoning and result of its July 30, 2019, opinion granting summary judgment to defendants, Dkt. 140, and its subsequent September 16, 2019, denial of plaintiff's motion for reconsideration, Dkt. 155, were correct. Second, there is no purpose served by forcing defendants, and the Court, to conjecture how the Court would conduct a remand in the event of an appellate reversal. Third, plaintiff provides no basis to justify a second reconsideration of the Court's summary judgment decision. In sum, plaintiff's motion utterly fails to raise[] a substantial issue, FRCP 62.1, let alone one that should short-circuit the appellate review that plaintiff himself initiated. Plaintiff, and plaintiff's counsel, are hereby put on notice that the Court considers this motion vexatious. Any further filings by plaintiff may result in severe sanctions to plaintiff, his counsel, or both. The Clerk of Court is respectfully directed to terminate the motion pending at docket 162. ORDER with respect to 101 Letter Motion for Leave to File Document. The Court has received defendants' pre-motion letter filed in anticipation of a summary judgment motion (Dkt. 101), plaintiff's letter in response (Dkt. 102), and defendants' reply (Dkt. 104). To the extent that plaintiff's letter suggests that discovery may remain open, that is incorrect. The deadline for fact discovery was October 4, 2018. This date passed without any application for an extension and with neither party indicating unresolved discovery disputes. Fact discovery is therefore closed. The parties are, however, expected, as defense counsel's reply letter anticipates, to attend to ministerial tasks attendant to discovery (e.g., exchanging and executing discovery transcripts). As to the anticipated summary judgment motions, the Court will use, as planned, the conference scheduled for November 1, 2018 as a pre-motion conference, and expects to set a prompt schedule for summary judgment briefing at that conference. Having received defendants' pre-motion letter (Dkt. 101) and plaintiff's response (Dkt. 102), the Court does not invite additional submissions in advance of the conference. The Court asks plaintiff's counsel henceforth to be attentive the Court's rules. Under the Court's Individual Rules, the parties' pre-motion letters were each limited to three single-spaced pages. ORDER granting 96 Letter Motion for Discovery; denying 97 Letter Motion for Discovery. The Court grants defendants' motion to quash the deposition subpoenas served on Michael Ullman and Theresa Nocerino. The Court further finds that the balance of equities tips decidedly in favor of conducting the disputed depositions in Manhattan, where the corporate defendant's office is located, the individual witnesses work and/or reside, and each side's counsel maintains an office. The Court therefore orders that the disputed depositions take place at a mutually convenient location on the island of Manhattan. The Court also grants defendants' motion for a protective order as to plaintiff's requests for the individual defendants' personal financial records and tax returns. This material is utterly irrelevant-so much so that plaintiff's request suggests a disquieting ulterior motive. It is conceivable that plaintiff might be entitled, under defined terms of disclosure, to anonymized information regarding the finances of applicants who applied roughly contemporaneously with plaintiff, to the extent that such information was presented to the Board. No such application has been made. But there is no conceivable valid reason for discovery of the personal finances of the individual defendants. Finally, the Court denies defendants' request that the Court direct plaintiff to depose 16C0D79 on September 11, 2018. Defense counsel objects to the deposition noticed for September 20, 2018, on the ground that this date is Yom Kippur. That is incorrect. This year, Yom Kippur falls on September 19. The deposition will proceed as noticed unless the parties mutually agree to conduct the deposition on September 22, 2018. ORDER. The Court has received plaintiff's request for a telephonic conference, styled on the docket as a motion to compel, seeking production of the names and mailing addresses of all shareholders of the Sherry Netherland. See Dkt. 63. The Court has also received defendants' letter in response. See Dkt. 64. Plaintiff's request for a telephonic conference is denied. Further, to the extent plaintiff moves to compel production of any materials, that motion is denied as well. Discovery has not yet begun in this matter, as the parties have not submitted a revised case management plan. Accordingly, plaintiff's request is, to say the least, premature. If plaintiff finds during fact discovery finds that he cannot obtain from the named defendants information he believes to be relevant and discoverable, the Court will entertain a renewed motion to compel.
