FINDINGS of FACT and CONCLUSIONS of LAW signed by Bankruptcy Judge Robert S. Bardwil on 4/28/2017 RECOMMENDING: that the motion be granted in part and judgment will be entered on the trustee's preference claim, as against Mr. Stern, and the 10/1 4/2015 transfer of $2,749,981.60 will be voided; judgment be entered on the trustee's constructive fraudulent transfer, as against BHI, and that judgment be entered against MOM under section 550(a) in the amount of $400,000; judgment b e entered on trustee's claim for turnover, as against Mr. Stern, in the amount of $1,162,769.44 remaining in the account as of the petition date or its value; and judgment be entered again BHI on the turnover claim in the same amount and against MOM in the amount of $310,000 transferred to it after the petition date.
