OPINION AND ORDER ON DISCOVERY MOTIONS re: [357] MOTION to Compel filed by Arlene Delgado, [355] MOTION to Compel filed by Arlene Delgado. For the reasons set forth below, Plaintiff's motion to compel and for sanctions at ECF Nos. 353 and 355 is DENIED; Plaintiff's motion to compel nonparty Brad Parscale to answer certain questions he refused to answer during his deposition at ECF No. 354 is DENIED; and Plaintiff's motion to compel the Defendants to answer certain Requests to Admit at ECF No. 357 is DENIED. Nonetheless, Plaintiff may make the inquiry concerning the production of two categories of documents pertaining to the decision not to hire her for a job in the White House as set forth above. Plaintiff may make this inquiry within the next 7 days, and Defendants must answer the inquiry within 7 days thereafter. Additionally, by July 3, 2024, Defendants shall confirm in writing to Plaintiff that they are not withholding written complaints of the type described above, properly requested in discovery and ordered by this Court to be produced. If in fact there are additional written complaints that were withheld, they must immediately be produced by no later than July 3, 2024. Plaintiff has not pointed to controlling decisions or information that the Court overlooked in any of its prior discovery orders concerning depositions. What Plaintiff in actuality is complaining about is the Court holding her to deadlines. When discovery started in this case, no restrictions were placed on the number of depositions. But, Plaintiff and her former counsel did not conduct third-party depositions within the time limits previously set by the Court. ORDER granting in part [321] Letter Motion to Compel. As to Plaintiff's first request regarding an extension of time, Mr. Parscale objects to such request on the grounds that it is untimely, and that Plaintiff fails to demonstrate good cause for an extension. Pursuant to my Individual Rules of Practice in Civil Cases, "Absent good cause, any request for extension or adjournment shall be made at least 48 hours or 2 business days, whichever is greater, before the deadline or scheduled appearance." Although Plaintiff failed to timely request an extension of the deadline to file the motion to compel, the Court realizes that Plaintiff only had three business days from the Court's Order at ECF No. 312 to request an extension. Out of solicitude for the Plaintiff, the Court hereby extends the deadline for Plaintiff to file a motion to compel Mr. Parscale to respond to unanswered deposition questions until Tuesday, June 4, 2024. Plaintiff shall file a formal motion to compel, including a memorandum of law, of no more than 10 double-spaced pages, as to the questions for which she believes there were improper direction not to answer. The motion should attach only those pages from the deposition transcript containing the questions and answers/directions not to answer at issue in the motion. The motion should explain why the information sought through the question is relevant to the parties' claims and defenses and proportional to the needs of the case. Mr. Parscale shall have until Tuesday, June 11, 2024, to file his opposition to the motion. No reply brief permitted. As to Plaintiff's second request regarding the subpoena of Brian Walsh, Plaintiff's letter does not appear to have been served on non-party Brian Walsh. Therefore, this Court is unsure whether, at this time, Plaintiff has obtained copies of the documents. Plaintiff shall promptly serve her letter and this Order on counsel for Brian Walsh, who shall have 3 business days after service to file a response to Plaintiff's letter motion. Plaintiff shall file an affidavit of service on the docket. Alternatively, if Walsh has provided the documents, Plaintiff shall, by June 7, 2024, file a letter stating that this issue is resolved. As to Plaintiff's third request concerning the Eric Trump privilege log, Plaintiff's letter does not appear to have been served on non-party Eric Trump. Plaintiff shall promptly serve her letter and this Order on counsel for Eric Trump, who shall have 7 days after service to file a response to Plaintiff's letter motion. DISCOVERY ORDER: As discussed at the May 1, 2024 ex parte call with Defendant and defense counsel regarding defense counsel's pending motion to withdraw: Rule 1.4 of the Local Rules of the United States District Courts for the Southern and Eastern Districts of New York governs the withdrawal of counsel. Rule 1.4 provides, in relevant part: An attorney who has appeared as attorney of record for a party may be relieved or displaced only by order of the Court and may not withdraw from a case without leave of the Court granted by order. Such an order may be granted only upon a showing by affidavit or otherwise of satisfactory reasons for withdrawal or displacement and the posture of the case, including its position, if any, on the calendar, and whether or not the attorney is asserting a retaining or charging lien. All applications to withdraw must be served upon the client and (unless excused by the Court) upon all other parties. The Rule permits, with Court authorization, submission of an in camera statement in appropriate circumstances. In this case, defense counsel's declaration is insufficient to grant withdrawal at this time. By May 7, 2024, defense counsel shall submit a more detailed declaration setting forth the basis for the deterioration in the attorney-client relationship sufficient for the Court to evaluate the motion. See, e.g., Wilson v. Pasquale's DaMarino's Inc., 2018 WL 4761574 (S.D.N.Y. 2018). Because of the nature of the motion and to protect attorney-client privilege, defense counsel shall submit the more detailed declaration to the Court in camera and on an ex parte basis. The declaration shall be emailed to Judge Parker's Chambers email with the subject line indicating the case number and that it is an in camera submission. The declaration shall also state whether defense counsel is asserting a retaining or charging lien and whether each of defense counsel's clients consent to the withdrawal. Defense counsel shall provide a copy of the declaration to a representative of Donald J. Trump For President, Inc. (the "Campaign") and Messrs. Priebus and Spicer. Because the Campaign is an entity, it may not represent itself. See e.g., Cent. Harlem Cmty. (Dist. 10) v. City of New York, 2024 WL 1603463, at *1 (S.D.N.Y. Mar. 8, 2024). Thus, if the motion to withdraw is granted, the Campaign will be at risk of default if it does not promptly obtain substitute counsel. As set forth in this Court's prior order, all deadlines remain in place. The next scheduled conference is May 9, 2024 at 4:30 p.m. by phone. Defense counsel shall ensure that all of its clients, including Messrs. Spicer and Priebus, are aware of the conference and dial-in number for that conference. Finally, this order does not preclude defendants from moving to substitute counsel by submitting a stipulation of substitution of counsel before any of the deadlines set forth herein. See Local Rule 1.4. If new counsel makes an appearance in advance of May 9, 2024, such new counsel shall attend the May 9, 2024 conference and be prepared for same. SO ORDERED. DISCOVERY ORDER: As set forth more fully on the record at the conference on April 24, 2024, the discovery issues raised by Plaintiff in ECF Nos. 248, 249, 250-52, 255 are resolved as follows: As further set forth by this Order. Having reviewed both letters and held oral argument at the Case Management Conference on April 24, 2024, Plaintiff's motion to compel is GRANTED in part and DENIED in part. Plaintiffs motion is GRANTED as to information concerning gender-related complaints against the Campaign during the 2016 and 2020 campaign cycles, including complaints of sexual harassment, gender, or pregnancy discrimination. Plaintiff's motion to compel information related to the amount in legal fees the Campaign has spent on the present litigation or the amount of cash/assets the Campaign currently possesses is DENIED. Plaintiff's request to have direct access to Defendants' storage vendor and her request that Defendants conduct further searches for organizational charts is DENIED. Plaintiff's request for additional time to depose Mr. Parscale is GRANTED. As discussed at the Conference, Plaintiff is permitted to depose Mr. Parscale for an additional three hours and is directed to schedule such deposition by May 7, 2024. By April 26, 2024, Plaintiff shall serve a copy of this Order on Fox and invite its counsel to attend the May 9, 2024 conference. For the reasons set forth above and as stated on the record at the April 24, 2024 Case Management Conference, Plaintiff's motion to compel is granted in part and denied in part. The Clerk of Court is respectfully requested to terminate the motion at ECF 248. A telephonic Case Management Conference is scheduled for May 9, 2024 at 4:30 p.m. concerning Plaintiff's motion to compel against Fox. DISCOVERY ORDER : The Court is in receipt of Plaintiff's letters regarding the deposition of Bradley Parscale scheduled for tomorrow. (ECF No. 241 and 242.) Plaintiff and Mr. Parscale are directed to move forward with the deposition in accordance with the directions set forth by the Court in its recent Order at ECF No. 238. Should Plaintiff find that more than 2.5 hours are needed for Mr. Parscale's deposition, she may write to the Court following the deposition to request permission to depose Mr. Parscale a second time on a date prior to May 7 that is mutually agreeable for the relevant parties. ORDER denying [235] Letter Motion for Extension of Time. Application denied. The Court understands that the hearing before the Honorable Aileen M. Cannon is scheduled to occur at 2:00 p.m. on April 12, and the deposition of non-party Mr. Parscale is scheduled to occur by video at 10:00 a.m. Plaintiff has represented that the deposition can be completed in under 3 hours, and the Court finds that it should be completed within 2.5 hours. Additionally, Mr. Parscale is represented by both Mr. Woodward and Mr. Gavenman, and it is the Court's understanding that Mr. Gavenman is not required to attend the hearing before Judge Cannon and therefore should be widely available to represent Mr. Parscale at the April 12 video deposition. There is no need for more than one attorney to defend the non-party deposition. Accordingly, the Court does not find that a meaningful conflict exists sufficient to create good cause for yet another extension of time for the deposition of Mr. Parscale. The deposition of Mr. Parscale is ordered to conclude no later than 12:30 p.m. on April 12 to allow Mr. Woodward sufficient time to attend the hearing before Judge Cannon, if he elects to participate in the deposition (as opposed to having his co-counsel, Mr. Gavenman, defend the deposition). The parties shall meet and confer regarding whether they can start the video deposition of Mr. Parscale at 9:00 a.m. on April 12 to allow additional time and flexibility for the deposition. ORDER GRANTING PRO SE PLAINTIFF PERMISSION TO FILE DOCUMENT UNDER SEAL Plaintiff has requested permission to submit a letter in camera that would explain to the Court what additional third party discovery Plaintiff seeks. Plaintiff seeks to file the letter in camera "so as to avoid unnecessary embarrassment to unrelated third parties" and "to avoid placing in the public record what would be considered work-product." ORDER granting in part and denying in part [176] Letter Motion to Compel. Upon good cause shown by Plaintiff and out of solicitude for Plaintiff's pro se status, the deadline for completion of discovery in this case is extended to April 15, 2024 solely for purposes of completing certain discovery that was not completed by Plaintiff's prior counsel. By February 6, 2024, Plaintiff shall provide to Defendants (i) a modified 30(b)(6) notice if needed, and (ii) a letter outlining what discovery Plaintiff believes remains outstanding from Defendants; and Defendants shall provide to Plaintiff (i) a copy of her deposition transcript in this matter, and (ii) the identity of their 30(b)(6) witness. The deposition of Reince Priebus shall occur on February 8, 2024. The deposition of the 30(b)(6) witness shall occur on a date between February 21 and February 29, 2024, inclusive. By February 12, 2024, counsel for Defendants shall determine a date that works for the 30(b)(6) witness within that range and advise Plaintiff of the date for the deposition. Plaintiff's prior counsel failed to meet deadlines for service of non-party subpoenas. Nevertheless, good cause having been shown, the Court will permit subpoenas for the depositions of nonparties Eric Trump and Brad Parscale to be served so long as they are served by February 22, 2024 and scheduled to occur by no later than April 15, 2024. Having missed prior deadlines, Plaintiff must seek leave of Court for additional third-party discovery and demonstrate any such proposed discovery is relevant and proportional to the needs of the case and can be accomplished by April 15, 2024. The Court will address any such requests at the court conference scheduled on February 28, 2024. All of the above-referenced dates are firm and final, and may not be moved without a good cause showing. In light of the numerous extensions already given and delays in this case that have occurred as a result of Plaintiff's counsel appearing and withdrawing close to deadlines, any future appearance of new counsel on behalf of Plaintiff will not constitute good cause for an extension of the April 15, 2024 deadline for completion of discovery. The letter motion to compel at ECF No. 176 is granted to the extent Defendants seeks portions of the deposition transcript of Plaintiff in her family court action during which Plaintiff addresses her job search efforts/employment after leaving the campaign because such information is relevant to mitigation and proportional to the needs of the case. The motion is otherwise denied. By February 20, 2024, Plaintiff shall produce the relevant portions of the deposition transcript as well as the PDF compilation of job applications/ rejections she described at yesterday's court conference. In light of the extension of the discovery schedule, the deadline for motions for summary judgment is extended to 30 days after the close of discovery, with opposition briefs due 30 days thereafter, and reply briefs due 15 days after the opposition briefs. A telephonic Case Management Conference is scheduled via the Court's Microsoft Teams conference line for Wednesday, February 28, 2024 at 2:00 p.m. At the scheduled time, the parties shall dial +1 646-453-4442, conference ID 800051869#. ORDER granting in part and denying in part [162] Letter Motion for Extension of Time to Complete Discovery. As discussed at the November 2, 2023 Case Management Conference: Plaintiff's letter motion for an extension of time (ECF No. 162) is granted in part and denied in part without prejudice. Specifically, the discovery deadline is extended to Friday, December 29, 2023 for the purpose of deposing Defendant Reince Priebus ("Priebus") and a 30(b)(6) witness for Defendant Donald J. Trump For President, Inc. (the "Campaign Witness.") By Tuesday, November 14, 2023, the parties shall have scheduled a date for the deposition of Priebus, and Plaintiff shall have provided a 30(b)(6) deposition notice to Defendants' counsel for the Campaign Witness. On Tuesday, November 14, 2023, Plaintiff shall file a letter advising the Court of the date scheduled for the deposition of Priebus and confirming that a 30(b)(6) deposition notice has been provided to Defendants' counsel for the Campaign Witness. Additionally, to the extent Plaintiff seeks a further extension of time to complete third-party depositions, this request shall be made in the November 14 letter. The letter should clearly and succinctly outline which third parties Plaintiff intends to depose and why those depositions would be relevant to any claims or defenses and proportional to the needs of the case in light of the testimony elicited from the parties. The letter should also state the length of time needed for these depositions, and should propose a reasonable timeline for completing the depositions. The letter should note whether the parties are in agreement as to any of the requests made in the letter. Defendant may file an opposition to Plaintiff's November 14 letter by Friday, November 17, 2023. The letters shall be limited to four pages in length. ORDER: On August 9, 2023, John M. Phillips, counsel for Plaintiff, filed a motion to withdraw as counsel and seeking to stay proceedings for 90 days to afford Plaintiff the opportunity to find new counsel. (ECF No. 153.) The motion represents that Plaintiff terminated Mr. Phillips' representation by email. By Tuesday, August 15, 2023, Mr. Phillips shall send a copy of that termination email to Parker_NYSDChambers@nysd.uscourts.gov for the Court's ex parte, in camera review. Mr. Phillips shall not copy Defendants on the email. In the event Plaintiff objects to Mr. Phillips' withdrawal, she shall file a letter of no more than 2 pages by Friday, August 18, 2023, stating her objection and succinctly providing the reason for her objection. In order to file the letter, Plaintiff should send the letter to Mr. Phillips, and Mr. Phillips shall file on ECF any letter received by Plaintiff. In the event Mr. Phillips does not receive a letter from Plaintiff by August 18, he shall file an affidavit on ECF by Monday, August 21, 2023 stating that no letter was received. At this time, Mr. Phillips' request for a stay is denied without prejudice. ORDER: On February 21, 2023, the Court received an ex parte, in camera submission by Plaintiff regarding her counsel's motion to withdraw as counsel. The submission requests an extension of time to file a supplemental ex parte, in camera submission on this issue. That request is GRANTED; Plaintiff may submit a supplemental in camera, ex parte submission of no more than five pages in length by Tuesday, February 28, 2023. Plaintiff's submission raised a concern regarding waiver of the attorney-client privilege. Additionally, Plaintiff's submission raised a concern regarding the potential of the various submissions to impact the Courts view of the parties. The Court reassures Plaintiff that the submissions do not impact the Courts view of the parties. The Court routinely deals with motions to withdraw involving disputes between clients and their lawyers, and it resolves such disputes in accordance with applicable law and rules. Such disputes do not impact the Court's decision-making on issues relating to discovery or any other issues, which the Court also resolves in accordance with applicable law and rules. In addition, because the Undersigned is only referred for General Pretrial and settlement, I will not be the decision-maker on any dispositive issue in this case. Such issues will be resolved by the Honorable Analisa Torres, and, if this case proceeds to a jury trial, by a jury. Plaintiff's counsel is directed to provide a copy of this Order to the Plaintiff. ORDER. By February 14, 2023, Plaintiffs counsel shall file a more explanatory affidavit supporting the motion to withdraw as counsel. To protect client confidences, and as permitted under applicable rules, the affidavit shall be submitted to Judge Parkers Chambers email ex parte for in camera review. ORDER terminating as moot [122] Motion to Appear Pro Hac Vice. Plaintiff Arlene Delgado is represented in this action by Daniel Shay Kirschenbaum of the law firm Derek Smith Law Group PLLC. On January 30, 2023, Mr. Kirschenbaum filed a motion and supporting papers seeking to withdraw as counsel for Ms. Delgado, asserting that there has been a breakdown in the attorney-client relationship. (ECF Nos. 124-26, 129-30.) The motion also seeks a 90-day stay of proceedings to afford Plaintiff the opportunity to obtain new counsel. By Friday, February 3, 2023, Defendants shall submit a letter of no more than three pages stating their position(s), if any, on the motion to withdraw and on the request to stay proceedings. An ex parte conference is scheduled with Ms. Delgado and Mr. Kirschenbaum on Wednesday, February 8, 2023 at 5:00 p.m. in order for the Court to learn more regarding the reasons for Mr. Kirschenbaum's motion while protecting the attorney-client privilege.
