ORDER: Plaintiffs have moved to compel the production of documents and deposition testimony by Defendant Tesla [53]. The motion is denied. The motion provides little more than summary positions--and general ones at that--about the items and things that Plaintiffs wishes to compel. Instead, Plaintiffs incorporate by reference and attach the "deficiency letters" between counsel and ask the Court to derive their positions from those letters. (Mot. to Compel dated Apr. 13, 2021 ("Mot."), Dkt. No. 53 at 1-2). The Court will not do so. This is a transparent attempt to skirt the Court's page limitations on discovery motions and avoid filing a motion seeking an expansion of those page limits. The Court's responsibility is not search through warring letters between parties --and approximately 300 pages of exhibits overall-- to divine the arguments pertinent to a motion to compel. If Plaintiffs wanted the Court to compel different answers to interrogatories or overrule objections or make any similar argument, they should have--like parties do in every other case--made specific arguments tailored to each request or group of requests, not proceed as they did. As for the motion to compel witnesses testimony, Plaintiffs ask the Court to review the entire deposition transcript, rather than providing examples--with citation to page and line number--with examples of the alleged deficiency in Tesla's 30(b)(6) witness. (Mot. at 2-3). As for the deposition notices, the parties are two ships passing in the night. Plaintiffs papers make it seem that Tesla has failed to produce witnesses for deposition; Tesla responds that the witnesses noticed for deposition are former employees over whom they have no control--and therefore presumably will not represent at the deposition. If Tesla's counsel does not intend to represent these former employees, they have no obligation--or ability--to make those witnesses available. But if they do intend to undertake representation, then they should facilitate and coordinate scheduling for them. Because it is not clear what witnesses are even being discussed--Plaintiff summary papers do not even bother to name the individuals about whom the motion is directed--the parties are directed to meet and confer about deposition scheduling.
