Judge Douglas P. Woodlock: ELECTRONIC ORDER entered granting 205 Joint Motion to Approve Further Notice of Settlement. In accordance with the Further Notice, the deadline for the ESOP participants to object to the settlement shall be October 12, 2020 and the final hearing to approve or disapprove the settlement shall be October 19, 2020. The Court further notes the failure of the parties to submit a proposed "Bar Order" with the Further Notice purportedly on the grounds that circulation of such an order with the Further Notice and its Appendix "would be more confusing than helpful." The Court is of the view that the proposed terms of any Bar Order will be material to informed judgment by the ESOP participants whether to object to the settlement and whether to appear and/or participate in the final hearing. In order to insure that the ESOP participants have a reasonable amount of time to review and evaluate the Bar Order the parties will propose, it is hereby FURTHER ORDERED that the parties shall jointly submit by docketing a motion for adoption of a Bar Order together with a proposed form of Order on or before October 1, 2020. The motion and proposed order shall be mailed to the ESOP participants on the same day the motion and proposed order are filed with the court. The mailing shall be accomplished in the same way the mailing of the Further Notice of Settlement and its Appendix are to be accomplished. The cost of this separate mailing shall be paid by defendant Diamond Antenna and Microwave Corporation and shall not be reimbursable by any of the other parties, their counsel or any insurance carriers or by the ESOP participants.
