MINUTE ORDER: Defense counsel has submitted a request to chambers for the issuance of trial subpoenas under Fed. R. Crim. P. 17(a) and (c). The Court hereby authorizes the issuance of Rule 17(a) subpoenas for trial testimony by the individuals identified by the defense. Counsel should submit their requests for blank subpoenas to the Clerk's Office for regular processing. As to the requested subpoenas for records under Rule 17(c), the defendant is ORDERED to file a motion for issuance justifying the requests under the applicable standards. See United States v. Nixon, 418 U.S. 683 (1974); United States v. Binh Tang Vo, 78 F. Supp. 3d 171 (D.D.C. 2015). The defendant may file his motion ex parte and under seal, provided that the motion contains an articulable basis for so proceeding. The Court will determine whether to direct a response from the government after reviewing the defendant's motion. Should the requests meet the applicable standards, the Court is prepared to order pre-trial return of any responsive, non-privileged records to defense counsel, subject to any objections lodged by the recipients.
