The Motion to Dismiss the 2nd Amend Complaint is now MOOT. The Motio to Strike the 3rd Amended Complaint has been DENIED. The 3rd Amended Complaint was filed within the dates noted on the scheudling order. Per MD Rule 2-341a the court will allow the defendants answer to the 2ed amended complaint to be treated as theanswer to the 3ed amended complaint since no other answer was filed, but becuase of the confustion regarding the removal and return of this case the court will allow the defendants to submit an additional answer, as well as any additional motion to dismiss regarding the 3ed amended complaint within 15 days of the docketed date of this order, if they desire to since the 3ed amended comaplaint contains new informaiton not contained in the 2ed amended complaint. If, and once filed, the court will set in a hearing for the motion to dismiss. The plaintiff shall not file any other amendments until the P's 15 days from the docketed date of this order have expired, and only may do so if no motion to dismiss is filed.
