TEXT ORDER. The court has reviewed the report filed by the parties at docket 17. The court will shortly issue a standard planning and scheduling order based on the information provided by the parties, but wishes to separately address the parties' concerns about procedures used by the assigned judge. As the parties doubtless know, the assigned judge is a district judge in the District of Alaska. As the parties may also know, to help what has been an overburdened court in Arizona, the assigned judge has presided over hundreds of civil cases in the District of Arizona. When doing so, the assigned judge uses the local rules of the Arizona court, not the local rules of the Alaska court. The form presented to the parties in the order at docket 12 does not reference the Alaska local rules. It therefore seems likely that the parties' confusion about which local rules are used comes from the information provided about the assigned judge on the Arizona Court's public website to which the order at docket 12 did refer the parties. The court apologizes for this confusion. With respect to motions in limine, the assigned judge sets a date which is either congruent with or somewhat later than the date set for filing dispositive motions. The procedure followed for setting a trial date is this: After the court has ruled on any motions for summary judgment and the date for completing discovery has passed, the court sends out an order asking the parties to suggest trial dates. The court then generally sets trial for one of the suggested dates, but in some cases the suggested dates are unworkable. In that circumstance, the court may schedule a trial setting conference. In any event once a trial date is determined, a standard order is filed setting pre-trial deadlines for such things as marking exhibits, filing final witness lists, filing trial briefs and scheduling a final pre-trial conference.
