EO: This action was dismissed without prejudice pursuant to 28 U.S.C. § 1915(g) on May 26, 2017. [ECF No. 4]. Plaintiff was told that he could refile his claims in a new action with concurrent payment of the filing fee. Plaintiff has not paid the civil filing fee, but has instead filed a Motion for Reconsideration pursuant to Fed. R. Civ. P. 59(e), a request for a stay of the action, and a Motion for Appointment of Mental-Health Panel to review Plaintiff's mental health and alleged physical injuries. [ECF Nos. 6, 7]. Plaintiff seeks a stay until after two Arizona state court hearings, scheduled for May 31, 2017, two weeks before he filed the Motions, have been held. Plaintiff's Motions do not support a finding that he was in imminent danger of serious physical injury now or when he filed his Complaint. See 28 U.S.C. § 1915(g). Nor do they persuade this Court to reconsider its May 26, 2017 Order dismissing this case without prejudice. Plaintiff's Motions, [ECF Nos. 6,7] are DENIED. This action remains CLOSED. Plaintiff may not proceed in this or another action with the claims he raises herein without concurrent payment of the civil filing fee.
