Electronic Clerk's Notes for proceedings held before Judge Nathaniel M. Gorton: Scheduling Conference held on 11/28/2017. Schedule adopted as follows: 1. Motions to join additional parties and to amend the pleadings must be filed by December 11, 2017. 2. Insofar as this matter involves the review of an administrative record whose content will be decided based on the methodology set forth herein, the parties are relieved of any mandatory disclosure requirements under Rule 26 of the Federal Rules of Civil Procedure and the Local Rules of the United States District Court for the District of Massachusetts, and as provided for in Fed. R. Civ. P. 26(a)(1)(B)(i). 3. Hartford shall provide Plaintiff with a Proposed Record for Judicial Review (Proposed Record) on or before December 18, 2017. The Proposed Record shall consist of the following documents arranged in an orderly fashion: (1) all non-privileged documents contained in Hartfords claim file concerning the administrative review of Plaintiffs claim; and (2) all applicable plan documents in the possession of Hartford. 4. If after receiving the Proposed Record the Plaintiff claims that the Proposed Record is incomplete or inaccurate in any way, Plaintiff must notify Hartfords counsel in writing of the same by January 5, 2018. If the Plaintiff does provide such notice, then the parties must confer in an attempt to agree upon the contents of the Record for Judicial Review. To the extent the parties disagree concerning the proper contents of the Record for Judicial Review, the parties shall file memoranda concerning any additional material they seek to have added to the Record for Judicial Review by January 26, 2018. Counsel to any party opposing such motion shall have three weeks to file an opposition thereto. 5. If any party proposes that it is entitled to any discovery, to constitute or supplement the Record for Judicial Review, it must file with the Court a submission showing cause for the partys entitlement to such discovery, outlining with a reasonable degree of particularity what discovery is sought, and explaining why the product of that discovery would be properly received at trial and would be material to the disposition of this civil action. Any submissions showing cause for entitlement to discovery must be filed by February 23, 2018. Counsel to any party opposing such motion shall have three weeks to file an opposition thereto. 6. Upon the Courts determination of all issues regarding the Record for Judicial Review, the Court shall decide the case based on the Record for Judicial Review. 7. Prior to filing Motions for Judgment on the Record for Judicial Review, the parties shall confer and file the Record for Judicial Review reflecting the parties agreement as to the content of the Record for Judicial Review and the rulings of the Court. The Record for Judicial Review shall be filed under seal. Notwithstanding the foregoing, memoranda for Judgment on the Record for Judicial Review do not have to be filed under seal. 8. Any party filing a Motion for Judgment on the Record for Judicial Review shall do so on or before the latter of: (1) February 5, 2018; or (2) 30 days after the Court has decided all motions concerning the Record for Judicial review or requests for discovery. 9. Any party filing an Opposition to a Motion for Judgment on the Record for Judicial Review shall do so on or before March 7, 2018.
