ORDER: Defendant FremantleMedia North America, Inc. ("Defendant") has moved for a discovery conference pursuant to Federal Rules of Civil Procedure 33 and 37 and Local Rule 37.2 to compel Plaintiff Codename Enterprises, Inc. ("Plaintiff") to produce written responses to Interrogatories 1318 in Defendant's Second Set of Interrogatories, served on November 23, 2016. Plaintiff served its response to these interrogatories on February 3, 2017, but objected on the grounds that they exceeded the 25-interrogatory limit provided for in Rule 33, and that two interrogatories were vague and/or irrelevant. Defendant argues that any objections that Plaintiff may have interposed to the interrogatories are waived because Plaintiff failed to respond or object to the interrogatories within 30 days of service. The record demonstrates, however, that Plaintiff conferred with and was granted additional time to respond by Defendant, initially to January 6, 2017. Though Plaintiff missed this deadline, additional discussions led to further extensions to January 27, 2017, and then February 3, 2017. Plaintiff also argues that the interrogatories violate Local Civil Rule 33.3. This objection was not raised previously. Plaintiff has not demonstrated good cause for failing to lodge these objections when it responded to the interrogatories of February 3, 2017. Accordingly, these objections are waived and cannot be raised in response to this motion. Plaintiff is ordered to respond to Interrogatories 1318 by Thursday, February 23, 2017. SO ORDERED.
