ORDER: The Court has been informed that this case has settled. Accordingly, it is hereby ORDERED that this action be conditionally discontinued without prejudice and without costs; provided, however, that within sixty (60) days of the date of this Order, the parties may submit to the Court their own Stipulation of Settlement and Dismissal. Otherwise, within such time Plaintiff may apply by letter for restoration of the action to the active calendar of this Court in the event that the settlement is not consummated. ORDER denying 61 Letter Motion for Extension of Time. Application denied. As Plaintiff points out in his letter, the Court has granted four extensions of the discovery deadlines in this case, including the deadlines for expert disclosures. Moreover, this request is made on the date of the deadline sought to be extended, which does not conform to the requirement contained in the Case Management Order that any request for an extension of a deadline be made no later than two business days prior to the date sought to be extended. Dkt. No. 23. Plaintiff has not shown good cause for a fifth extension of the disclosure deadline. Therefore, the deadlines established in the Court's December 15, 2017 order (Dkt. No. 53) remain in place. SO ORDERED. (Signed by Judge Gregory H. Woods on 2/14/2018) (anc)

ORDER. The Court has reviewed the parties' submissions regarding the applicability of the Patient Safety and Quality Improvement Act ("PSQIA") to the Patient Safety Reports that Plaintiff sought to be produced. The Court finds that the Patient Safety Reports identified by Defendant in its briefing were prepared exclusively for reporting to a patient safety organization and were actually submitted to the patient safety organization. The Patient Safety Reports are therefore "patient safety work product" as that term is defined under the PSQIA, 42 U.S.C. section 299b-21(7). As such, those reports are privileged under the Act from production in this matter. 42 U.S.C. section 299b-22(a). (HEREBY ORDERED by Judge Gregory H. Woods on December 27, 2017) (Text Only Order)(Woods, Gregory)

ORDER. On December 11, 2017, the Court extended the deadline for the filing of Defendant's supplemental briefing concerning the applicability of the Patient Safety and Quality Improvement Act. Dkt. No. 49. Under the extended briefing schedule, Plaintiff's response to Defendant's supplemental briefing was due on December 19, 2017. The Court has not received Plaintiff's response. Plaintiff is directed to file his response, if any, no later than December 21, 2017. If, following his review of Defendant's supplemental submissions, Plaintiff has determined that he wishes to withdraw his objection to the Defendant's assertion of privilege, in the interest of judicial economy, the Court requests that the Plaintiff inform the Court of that fact no later than December 21, 2017. In the event no response is filed by December 21, 2017, the Court will treat Defendant's supplemental briefing as unopposed and rule on the applicability of the Act's privilege in due course without the benefit of Plaintiff's additional arguments.
