CONSENT ORDER pltf & all defts have advised the court that they have agreed upon terms of a settlement of their disputes which will result in the dismissal with prejudice of the verified complaint for declaratory and injunctive relief and damages and an instruction to deft Crestar Bank to immediately pay over to pltf all funds on deposit at Crestar Bank in the name of or on behalf of deft 2800 Crusader Associates which Crestar Bank has indicated in a pleading to be $113,181.78. Accordingly, all parties having indicated their consent and agreement to the terms of this consent order and it appearing to this court that entry of this order is appropriate and in the best interests of justice, it is this 1st day of December, 1993 ORDERED: 1. Deft Crestar Bank shall pay to pltf all funds on deposit at Crestar Bank in the name of and/or on behalf of deft 2800 Crusader Associates held in accordance with the order authorizing Writ of Attachment before judgment and the writ of attachment before judgment in this action; 2. Upon the making of the payment by Crestar Bank, the verified complaint shall be dismissed with prejudice as against all defts', 3. Circle Real Estate Partners, L.P.'s motion for partial summary judgment shall be deemed withdrawn; 4. The defts' motion to dismiss for lack of jurisdiction, motion to dismiss for defective pleading, motion to transfer venue and motion to quash attachment shall be deemed withdrawn; 5. Upon the payment by Crestar Bank in accordance with paragraph 1 above, the writ of attachment shall be deemed satisfied by Crestar Bank; and 6. Upon the entry of this order, the clerk of the court shall cause the $200,000 cash bond posted by pltf on August 11, 1993 to be immediately returned to pltf's counsel and made payable to Circle Real Estate Partners, L.P.
