Court ruled that the hearing is continued with the conditions: That the Temporary REstraining Order remain in effect for thirty (30) days (until 12/6/01); That if the parties have not resolved the matters or reached an accord with respect to entering a preliminary injunction or otherwise on December 6, 2001, the Court will issue its ruling on the motion for preliminary injunction based on the current record before the Court; That the parties will be allowed to present to the Court an order or a series of orders requesting amendments to the current Temporary Restraining Order as the parties are able to resolve the issues. The Court will memorialize its (oral) order just entered in the form of an order to the parties. At the request of counsel for Bank of Hampton Roads, the Court will enter their proposed order on the pending motion for relief from the TRO allowing funds to be paid over to the receiver.
