IT IS HEREBY STIPULATED AND AGREED between Plaintiff Walmart
Inc. (“Plaintiff” or “Walmart”) and Defendant Tesla Energy Operations, Inc.
(“Defendant” or “Tesla”) that Tesla’s time to answer or otherwise respond to the
Complaint is extended up to and including October 26, 2019. Tesla’s current deadline
to respond to the Complaint is September 26, 2019 – thirty days after August 27, 2019,
which is when Walmart served the Complaint. By email dated September 11, 2019,
the parties agreed to stipulate to extend Tesla’s time to answer or otherwise respond to
the Complaint by thirty days. Accordingly, Walmart and Tesla hereby stipulate to
extend Tesla’s deadline to respond to Walmart’s complaint to October 26, 2019.
