Plaintiff claims during February 2021, Tesla informed him that a vehicle reservation placed on 04:30 2019 for a FSD RWD
Model ( secured with a$ 2500 deposit) was no longer planned for production and that the customer, if amicable, would be
accommodated
with
a substitution
to fulfill the pending
order.
The plaintiff met in person with Tesla' s sales and operational
employees at its Cathedral City CA location on several occasions during the week of February 1, 2021 to locate a suitable
replacement vehicle. Once located, plaintiff was provided a revised addendum to the Motor Vehicle Order Agreement on
02/ 03/ 2021 produced by Tesla operations associate Jair? Indicating electronic accepted terms. A revised pricing sheet
accompanied the vehicle configuration change that included a change of vehicle from RWD to AWD. The Car Price was
enumerated as$ 55,200 and with trade in and credits the Amount Due was specified as$ 19,665.00. The identical

A few days before delivery, however,Tesla had modified the pricing to reflect prices that were provided at the time of the
initial preorder which resulted in an additional$ 4,401 in the total amount due. Plaintiff was informed that the pricing was
erroneous and that failure to accept delivery would likely result in further delays or alternatively a refund of the deposit
retained for nearly 2 years could be processed. Under protest and duress, the delivery was accepted with conditional
assurance that the discrepancy should be easily resolved through the dispute resolution process.
Plaintiff has sent a total of 5 emails over the past 5 months to resolutions@tesla. com and have only received an automated
reply
indicating
that message
was
received and that
someone
would contact.
Plaintiff documentation includes each of
these emails, numerous emails to company representatives, discussions with Independent arbitration company informing
customer that scope was limited to mechanical warranty related issues. Tesla provides no way for plaintiff to reach an
authorized member of management to resolve the dispute, doesn' t have a public relations group available assist, restricts
to its legal department.
Essentially my claim has been ignored and not reviewed., This practice is a fundamental
violation of fair practices in reviewing and attempting to resolve consumer complaints in good faith. Appears that Tesla had
decided that it' s more beneficial for them to ignore the dispute.
This practice enriches Tesla with reduced overhead costs

to the known detriment of its customers. While I am afforded the benefit of remedy through small claims, I suspect those
subject mandatory arbitration are not provided any reasonable process to resolve a dispute similar to mine.
The sad thing about this situation is that I'm very happy with the vehicle and ama previous owner but express extreme
dissatisfaction with the customer relation process. This should have been resolved long ago as the facts are clear and
straightforward. Forcing me to bring Tesla to court simply to either be heard or provided with just remuneration is not an
acceptable process nor is it conducive to building trust and loyalty.

Plaintiff claims during February 2021, Tesla informed him that a vehicle reservation placed on 04:30 2019 for a FSD RWD
Model ( secured with a$ 2500 deposit) was no longer planned for production and that the customer, if amicable, would be
accommodated
with
a substitution
to fulfill the pending
order.
The plaintiff met in person with Tesla' s sales and operational
employees at its Cathedral City CA location on several occasions during the week of February 1, 2021 to locate a suitable
replacement vehicle. Once located, plaintiff was provided a revised addendum to the Motor Vehicle Order Agreement on
02/ 03/ 2021 produced by Tesla operations associate Jair? Indicating electronic accepted terms. A revised pricing sheet
accompanied the vehicle configuration change that included a change of vehicle from RWD to AWD. The Car Price was
enumerated as$ 55,200 and with trade in and credits the Amount Due was specified as$ 19,665.00. The identical
information was also displayed on the customer app. The Plaintiff materially relied on the accuracy and propriety of the
information
and
prepared
for
delivery
and necessary
arrangements
to secure
funding,
etc.

the lower price associated with FSD and accommodated the nominal pricing difference between the 2 vehicles at the time).
A few days before delivery, however,Tesla had modified the pricing to reflect prices that were provided at the time of the
initial preorder which resulted in an additional$ 4,401 in the total amount due. Plaintiff was informed that the pricing was
erroneous and that failure to accept delivery would likely result in further delays or alternatively a refund of the deposit
retained for nearly 2 years could be processed. Under protest and duress, the delivery was accepted with conditional
assurance that the discrepancy should be easily resolved through the dispute resolution process.
Plaintiff has sent a total of 5 emails over the past 5 months to resolutions@tesla. com and have only received an automated
reply
indicating
that message
was
received and that
someone
would contact.
Plaintiff documentation includes each of
these emails, numerous emails to company representatives, discussions with Independent arbitration company informing
customer that scope was limited to mechanical warranty related issues. Tesla provides no way for plaintiff to reach an
authorized member of management to resolve the dispute, doesn' t have a public relations group available assist, restricts
to its legal department.
Essentially my claim has been ignored and not reviewed., This practice is a fundamental
violation of fair practices in reviewing and attempting to resolve consumer complaints in good faith. Appears that Tesla had
decided that it' s more beneficial for them to ignore the dispute.
This practice enriches Tesla with reduced overhead costs
access
to the known detriment of its customers. While I am afforded the benefit of remedy through small claims, I suspect those
subject mandatory arbitration are not provided any reasonable process to resolve a dispute similar to mine.
The sad thing about this situation is that I'm very happy with the vehicle and ama previous owner but express extreme
dissatisfaction with the customer relation process. This should have been resolved long ago as the facts are clear and
straightforward. Forcing me to bring Tesla to court simply to either be heard or provided with just remuneration is not an
acceptable process nor is it conducive to building trust and loyalty.
