ORDER The Court had a telephonic conference with the parties to resolve disputes pertaining to the Court's previous discovery order (Dkt. # 296). At the conference the Court ruled: 1. Plaintiffs are not entitled to require the QED defendants to place any amount in escrow prior to beginning the process of timely producing documents pertaining to their Corporate Advocacy Program.2. The Parties will cooperate and use the most efficient methods possible in producing the documents. To assist in that process, all of the customer information contained in the produced documents will be treated by all parties as confidential and will be subject to appropriate protection, including, to the extent applicable, the confidentiality order previously entered in this matter. 3. Plaintiffs are further entitled to identify and eliminate from production such documents as are attorney-client privileged. Given that the documents are all in electronic format Plaintiffs should identify such documents through the use of electronic searches that will facilitate the identification and review of documents that are subject to the privilege. Should such privileged documents be inadvertently disclosed they will be returned to the Plaintiffs unexamined by the QED Defendants except to the extent that examination was necessary to identify the document as subject to the attorney-client privilege. 4. The QED defendants will pay the necessary and reasonable expenses of the document production as specified in the previous order. To the extent that the parties are unable to agree on an appropriate amount, the Court will resolve the dispute. ORDER The parties have kindly informed the court telephonically that although their stipulation only refers to the February 19, 2008 scheduling order, Judge Wake later extended some of the deadlines in an August 21, 2008 order. In that August order the court extended the deadlines for defendants expert disclosure and plaintiffs rebuttal disclosure (November 14). The Court further extended the fact discovery deadline until January 9, 2009, the dispositive motion deadline until January 23, 2009, and the deadline for the Joint Proposed Pretrial order until January 30, 2009. As a result, the Court acknowledges that the parties have submitted their extension request prior to the expiration of the relevant deadlines. It further acknowledges that the court's text entry order of this date misstates the deadlines pertaining to the deadlines for factual discovery, the submission of case-dispositive motions, and the date for submission of the Joint Proposed Pretrial Order. Therefore, the court grants the parties' motion to vacate its previous text entry order of this date. Nevertheless, the parties stipulation would still as a practical matter, require the court to reset the dates for discovery cut-off, the dispositive motion deadline, and the date for the Joint Proposed Pretrial order. The parties stipulation still provides no cause on which to do so. However, because it works no hardship to the Court's other established deadlines, the Court grants up to, and including January 16, 2009 in which to complete the expert depositions in this matter. Should the parties desire to extend the deadline for the completion of expert depositions beyond this date, or extend any of the other remaining deadlines, they must provide cause on which to do so consistent with Judge Wake's February 19, 2008 scheduling order.. ORDER denying [228] Stipulation : On February 19, 2008 the Court entered a Case Management Order. That order, among other things, required that expert depositions be completed by October 10, 2008, and that all discovery be completed by October 31, 2008. It further imposed a dispositive motion deadline of November 14, 2008 and required a Joint Pretrial Order to be filed by November 21. That order further specified that "[t]he parties are advised that the Court intends to enforce the deadlines set forth in this order. The Court will not extend the case processing deadlines because the parties wish to avoid litigation expense." The Case Management Order further stated "absent extraordinary circumstances the court will not entertain expert discovery disputes after the dealine for completion of expert discovery. Delay in presenting discovery disputes is not a basis for extending discovery deadlines." The parties" stipulation, filed on November 12, 2008, requests an extension of time in which to complete expert deposition from October 10, 2008 until February 10, 2009. It offers no reason justifying the extension of the deadline. The court declines to enter such an order for the following reasons. First, the stipulation was not filed until more than a month after the deadline had expired. As the Court previously noted "delay in presenting discovery disputes is not a basis for extending discovery deadlines." It is true that the parties have stipulated to the extension, thus the matter is not technically a "dispute." However, the difference between a "discovery dispute" and a "discovery request" in this context is not material. The parties were advised in the scheduling order that the deadlines would not be extended without good cause and, they were further advised that the court would not extend the deadlines merely to avoid litigation expense for the parties. The parties have not provided any reason to believe that there requested extension is for good cause. Further, although the parties do not acknowledge as much, the Court cannot practically alter the deadlines for completing expert depositions without altering the other deadlines in the case. The dispositive motion cut-off is November 14th and the deadline for filing the Joint Pretrial order is November 21st. Thus, in the absence of a timely request, due to the "domino" affect the request would have on other deadlines, and in the absence of any asserted "good cause" in which to extend the deadlines, the stipulated extension is denied.
