The Court's June 4, 2020 Order directed that in the event "Defendants do not concede to [Plaintiffs'] proposed damages model, Defendants SHALL provide to Plaintiffs a detailed explanation of their objections." After providing its objections according to the Court's Order, Defendants now assert that "should litigation [regarding the objections]... be necessary, defendants reserve the right to rebut plaintiffs' damages model on any basis, whether stated in the letter or not." It goes without saying that, when the Court orders that a party provide another party with a "detailed explanation of their objections", the providing party is expected to present a FULL and COMPLETE list of its objections, placing the receiving party on notice of its objections. A party may not "reserve the right" to raise unstated objections, thus allowing it to only partially respond to the Court's order. See In re Papst Licensing GMBH & Co. KG Litig., 550 F. Supp. 2d 17, 22 (D.D.C.), order clarified sub nom. In re Papst Licensing GMBH & Co., KG Litig., 250 F.R.D. 55 (D.D.C. 2008) (finding that the sanction of a waiver was appropriate when a party failed to adhere to an unambiguous court order based on a claim that it misunderstood the court's order, but did not seek clarification). Therefore, the Court finds that any objections not articulated in Defendants' statement of objections provided to Plaintiffs in response to the Court's June 4, 2020 Order are HEREBY waived. MINUTE ORDER. Pending before the Court are plaintiffs' objections to [335] Magistrate Judge Facciola's order granting in part and denying in part [325] plaintiffs' motion to compel discovery responses. On non-dispositive matters, the Court reviews the magistrate judge's ruling under Federal Rule of Civil Procedure 72(a), which directs the Court to "modify or set aside any part of the [magistrate judge's] order that is clearly erroneous or is contrary to law." Fed. R. Civ. P. 72(a); see also Local Civ. R. 72.2(c). Under this deferential standard, the magistrate judge's ruling must be affirmed "unless on the entire evidence the court is left with the definite and firm conviction that a mistake has been committed." Collett v. Socialist People's Libyan Arab Jamahiriya, 448 F. Supp. 2d 92, 95 (D.D.C. 2006) (internal citations and quotation marks omitted). Plaintiffs object to only two aspects of Judge Facciola's ruling: (1) the denial of plaintiffs' motion to compel as to the post-October 12, 2005 documents pertaining to discussions of promotions at meetings of the Career Board, and (2) the denial of plaintiffs' motion to compel as to the post-November 15, 2005 documents concerning communications conducted outside of DEA Career Board meetings about DEA promotions to GS-13 or above. With respect to the post-October 12, 2005 documents pertaining to discussions of promotions at meetings of the Career Board, Magistrate Judge Facciola concluded that these documents were not relevant because, in the long history of this case, the circumstances of decisions made in individual cases have never been at issue. Moreover, he concluded that the value of discovery as to individual promotion decisions was outweighed by the burden and expense to the government. See Fed. R. Civ. P. 26(b)(2)(C)(iii). With respect to the post-November 15, 2005 documents concerning communications conducted outside of DEA Career Board meetings about DEA promotions to GS-13 or above, Magistrate Judge Facciola concluded that plaintiffs had offered nothing more than vague and unsupported speculation regarding the inadequacy of defendant's response and thus did not compel the conclusion that the search was inadequate. Plaintiffs do not argue, nor can the Court conclude, that Magistrate Judge Facciola's rulings were erroneous or contrary to law; rather, plaintiffs merely rehash arguments previously made. Accordingly, it is hereby ORDERED that plaintiffs' objections to Magistrate Judge Facciola's Order are OVERRULED. It is FURTHER ORDERED that, by no later than August 1, 2012, the parties shall file a joint status report with a recommendation for further proceedings, including a proposed schedule for the conclusion of briefing on [303] plaintiffs' motion for compliance and to show cause, and [316] defendant's motion to vacate.
