MINUTE entry before Judge Sidney I. Schenkier : On 08/27/07, the Court issued Findings of Fact and Conclusions of Law (doc. # 101). On that same date, the Court issued a minute order directing the parties to file a joint submission setting forth, based on the Court's findings and conclusions, their respective views as to the proper amount of damages, prejudgment interest, liquidated damages, and audit costs (doc. # 100). The Court ordered that submission to be filed by 09/11/07; thereafter, at the parties' various requests, the Court extended the time for filing the submission on three separate occasions (doc. ## 104, 111, 115). The parties timely filed their submission on 10/26/07, the most recent due date (doc. # 117). However, that submission was accompanied by plaintiffs' motion for leave to file a response to the areas of disagreement expressed by defendant in the joint submission (doc. # 119). The Court has reviewed the motion and the submission, as well as defendant's objection to plaintiffs' motion to file a response (doc. # 121). The purpose of having the parties file a joint submission was to require them to confer about these calculations, so as to reduce the range of dispute and to present any disputes that remain in a more efficient manner without additional briefing. However, we are persuaded that defendant frustrated that purpose by failing to deliver its objections to the plaintiffs' proposed calculations until the afternoon of 10/26/07, the date the submission was due. Accordingly, we grant plaintiffs' motion (doc. # 119). By 11/05/07, plaintiffs shall file a response, limited to addressing any objections expressed by defendant in the joint submission. MINUTE entry before Judge Sidney I. Schenkier : ENTER FINDINGS OF FACT AND CONCLUSIONS OF LAW (attached). After consideration of the evidence and argument offered during the bench trial and the parties' proposed findings of fact and conclusions of law, the Court enters judgment in favor of plaintiffs and against defendant on the issue of liability. The Court finds that plaintiff failed to make required contributions to the Local 5 ERISA and non-ERISA Funds (other thatn CEA) for 161, 998, 75 hours of covered work, and to CEA for 11,018.75 hours of covered work. The Court further finds that the defendant failed to forward required payment of union dues to Local 5 for 6,180 hours of work. Based on this judgment on liability, the Court directs that by 9/11/07, the parties submit to the Court: (a) a calculation of the amount of contributions and union dues that defendant owes to the plaintiffs; (b) a calculation of prejudgment interest due through August 27, 2007; (c) a calculation of liquidated damages; and (d) a statement of audit costs. The submission shall be a joint one, with the parties identifying in the joint submission any areas of disagreement, the basis for them, and any competing calculations they wish the Court to consider. By 9/11/07, plaintiffs also shall submit their bill of costs. The matter is set for a status conference on 9/18/07 at 9:00 a.m. Prior to that time, the parties shall meet and confer on the question of attorneys' fees to be awarded to plaintiff, and shall be prepared to propose to the Court a schedule for briefing any disputed issues concerning attorneys' fees.
