STIPULATION AND ORDER AMENDING THE PARTIES' STIPULATION AND AGREEMENT OF SETTLEMENT OF MARCH 19, 2010 AND EXHIBITS 1 AND 4 THEREOF AND AMENDING THE OFFICIAL COURT NOTICE OF PROPOSED SETTLEMENT OF CLASS ACTION AND THE COURT'S ORDER OF APRIL 20, 2010: It is hereby stipulated and agreed that Exhibits 1 and 4 of the Parties' Stipulation and Agreement of Settlement of March 19, 2010, amended per Order signed and filed May 21 and May 23, 2010, are further amended to the forms annexed hereto as Exhibits 1 and 4 respectively and that the Official Court Notice of Proposed Settlement of Class Action, Exhibit A appended to the Preliminary Order signed on April 19, 2010, also amended per the Court's Order signed and filed May 21 and May 23, 2010, is further amended to the form annexed hereto as Exhibit 4 and in the event of any conflict between the terms of the Parties' Stipulation and Agreement of Settlement of March 19, 2010 and the annexed Exhibits 1 and 4 the terms of the annexed Exhibits 1 and 4 shall be controlling. It is further stipulated and agreed that, while not anticipated, further change in the distribution of the Net Settlement Fund specified in the Plan of Allocation may be set forth in the Notice of Proposed Settlement of Class Action, Exhibit 4, and Allocation Schedule, Exhibit 1 hereto, provided that the total amount of the Net Settlement Fund as currently set forth in Exhibit 4, no less than $3,616,000, does not change and that the only change in the Plan of Allocation is the number of Class Members and any resulting change in distribution of the Net Settlement Fund. It is further stipulated and agreed that the dates specified in the Court's Preliminary Approval Order of April 19, 2010, are changed as follows: (1) The Settlement Fairness Hearing set for August 16, 2010 at 2:30 p.m., specified in paragraph 5 of such Order is hereby adjourned to 10/7/2010 at 11:00 a.m. (2) The Notice of Proposed Settlement of Class Action and proof of claim, in the form annexed hereto as Exhibit "4", which was to be mailed and emailed as specified in paragraph 8 of such Order, shall now be so dispatched no later than 15 days from the date of this Order. (3) Proof of claim forms, which were to be filed as specified in paragraph 10 of such Order, shall now be so filed within 60 days from the date of this Order. (4) Requests for exclusion from the class, which were to be filed as specified in paragraph 11 of such Order, shall now be so filed within 60 days from the date of this Order. (5) Plaintiffs' counsels' papers in support of final approval of the settlement, which were to be filed as specified in paragraph 13 of such Order, shall now be so filed within 74 days from the date of this Order. (6) Objections and comments on the settlement, which were to be filed and served as specified in paragraph 13 of such Order, shall now be so filed and served within 60 days from the date of this Order. STIPULATION AND ORDER PROVIDING FOR SUPPLEMENTAL CLASS NOTICE AS PER FEDERAL RULES OF CIVIL PROCEDURE RULE 23: IT IS HEREBY STIPULATED AND AGREED, by and between the below signed parties and their attorneys, that: Pursuant to the parties' Stipulation of June 16, 2009, "So Ordered" by the Court on June 18, 2009, the parties agreed upon a form of notice to the members of the class certified by the Court's Memorandum and Order of April 13, 2009 and a process for such class members to exclude themselves from the class, the Court further finding that such process complied with all requirements of Fed. R. Civ. Pro. Rule 23 (c)(2) and all other due process requirements; and An error having occurred in the notice dispatched by postal mail pursuant to the aforesaid Stipulation and Order, in that such notice omitted the full address of defendants' counsel, which is to receive from all excluding class members a copy of the class member's "opt out" form under the process set forth in such Stipulation and Order; and The parties having agreed to correct the aforesaid error by dispatching, by postcard, in substantially the form annexed hereto, a corrective notice to all class members who (1) Have not already validly "opted out" of the class and (2) Have not had their original mailed postal notice returned as undeliverable; and Within 12 days of this Court "So Ordering" this Stipulation plaintiffs' counsel shall mail the parties' attached and agreed upon corrective notice by first class mail postcard to all class members who have not already validly "opted out" of the class and have not had their original mailed postal notice under the parties' Stipulation of June 16, 2009 returned as undeliverable, and such persons shall have until 30 days after such mailing to validly "opt out" of this case; and The parties agree, and the Court so finds, that the form of notice provided for in this Stipulation and Order, combined with the notice already provided under the parties "So Ordered" stipulation and Order of June 16, 2009, fully complies with all requirements of Fed. ORDER The Court is in receipt of a letter dated 10/29/04, containing a request for an extension of discovery from plaintiffs. Its appears that plaintiffs have been highly dilatory in conduction discovery in this matter-- in particular, with respect to their obligation to raise discovery disputes with the Court promptly. Nonetheless, the Court will not bar discovery altogether. Rather, the Court rules as follows: neither party may serve any new discovery request, other than notices of deposition. With respect to disputes about existing requests, any such dispute must be brought to the court's attention on or before 11/12/04 by means of a letter that complies with paragraph 2(A) of this Court's Individual Practices (which, it should be noted, requires attorneys to confer prior to sending any letter). Any failure to comply with this deadline will preclude the party from raising such dispute in the future. Should such a letter be received, the Court expects to act on it promptly. Depositions may be conducted as long as they are completed by 1/15/05. There will be no discovery permitted except as set forth in this Order. So Ordered. (Signed by Judge Gabriel W.
