Since then, the parties have continued to report that they are working to finalize the settlement terms and have blown through the discovery cut-off date (April 30, 2012) scheduled by the assigned District Judge. The court believes that the parties have had ample time to nail down the terms of their agreement. At the next status hearing, the parties will be required to specify a date when a motion for preliminary approval will be filed. If the parties are unable to specify a filing date, the court will lift the discovery stay, issue a schedule for completing oral discovery and order the parties to seek an extension of time to complete discovery from the assigned District Judge.
