Notwithstanding paragraphs 1 and 2 of this Order, in the event that EPA fails to comply with paragraph 3 or paragraph 1 of the Agreement, plaintiffs shall have the right to reopen this action pursuant to paragraph 10 of the Agreement. 4. AMENDED CONSENT DECREE; it is hereby ordered, adjudged and decreed that for the purposes of this Consent Decree, the terms defined in the recitals hereof or in other paragraphs shall have the meanings ascribed to them therein and the following terms shall have the meanings ascribed to them as set forth in this document. EPA may implement section 316(b) of the Clean Water Act by conducting three separate rulemaking proceedings: the Phase I Regulations, the Phase II Regulations, and the Phase III Regulations. Each of these shall have the definition stated in this document. The Adminstrator shall meet the following deadlines: (1) the Adminstrator shall take Final Action with respect to the Phase I Regulations by 11/9/01; (2) the Adminstrator shall propose the Phase II Regulation by 2/28/01, and shall take Final Action with respect to the Phase II Regulations by 8/28/03; (3) the Admistrator shall propose the Phase III Regulations by 6/15/03, and shall take Final Action with respect to the Phase III Regulations by 12/15/04. Within 5 business days after each of the dates listed in this Amended Consent Decree, EPA will notify pltffs and the Court whether the Agency has performed the task corresponding to the dates listed. This Decree constitutes a final written expression of all the terms of this Decree and is a complete and exclusive statement of those terms. No statements, representations, agreements or promises that are not included herein shall be of any force or effect, unless they have been reduced to writing and signed by counsel for all parties. Upon entry of this Decree, the Consent Decree entered by the Court on 10/10/95; shall be deemed to have been terminated, vacated, set aside, replaced and superseded by this Decree and shall have no further force or effect. This Consent Decree is agreed to by Pltffs in full satisfaction of all claims brought by pltffs in this action, except as provided in paragraph 8 of this document. ( signed by Judge Allen G.
