Each party shall also file with the Joint Disputed Claim Terms Chart and appendix containing a copy of each item of intrinsic evidence cited by the party in the Joint Disputed Claim Terms Chart; (7) The parties shall complete the ADR process by November 3, 2008; (8) Plaintiff shall file and serve an Opening Claim Construction Brief and an identification of extrinsic evidence by November 17, 2008; (9) Defendants shall file and serve a response to the Opening Claims Construction Brief, an identification of extrinsic evidence and any objections to extrinsic evidence by December 19, 2008; (10) Plaintiff may serve and file a reply directly rebutting the opposing party's response, and any objections to extrinsic evidence by January 9, 2009; (11) The Court will conduct a hearing on the issue of Claim Construction on February 2 and 3, 2009; (12) The parties shall complete fact discovery by 60 days after the Court issues its claim construction decision; (13) Each party shall make its initial expert witness disclosures, as required under Rule 26, on the issues on which each bears the burden of proof within 30 days of the close of fact discovery; (14) Each party shall make its initial expert witness disclosures, as required under Rule 26, on the issues on which the opposing party bears the burden of proof by 30 days after the first round of expert disclosures; (15) rebuttal expert witness disclosures must be made by 10 calendar days after the second round of expert disclosures; (16) Expert depositions, if any, must be completed by 30 days after rebuttal expert disclosures are made; (17) Motions for summary judgment must comply with Local Rule 56.1 and must be filed within 30 days after the completion of expert discovery. SCHEDULING ORDER: (1) Parties shall comply with the Initial Disclosures required by Rule 26(a)(1) and Local Patent Rule 3.1 by 7/15/2008, with the understanding that Defendants will provide rolling disclosures; (2) The parties shall move to amend the pleadings or add new parties by 8/31/2008; (3) Plaintiff shall serve on all parties a Disclosure of Asserted Claims and Infringement Contentions by 7/31/2008; (4) Defendants shall serve on all parties a Disclosure of Non-Infringement and Invalidity Contentions by 9/12/2008; (5) Each party shall simultaneously exchange Proposed Claim Terms and Phrases for Construction by 9/24/2008; (6) The parties shall meet and confer by 10/4/2008 to identify claim terms and phrases that are in dispute, and claim terms and phrases that are not in dispute and prepare and file a Joint Disputed Claim Terms Chart. Each party shall also file with the Join Disputed Claim Terms Chart an appendix containing a copy of each item of intrinsic evidence cited by the party in the Joint Disputed Claim Terms Chart;(7) The parties shall complete the ADR process by 10/12/2008; (8) Plaintiff shall file and serve an Opening Claim Construction Brief and an identification of extrinsic evidence by 11/3/2008; (9) Defendants shall file and serve a response to the Opening Claims Construction Brief, an identification of extrinsic evidence and any objections to extrinsic evidence by 12/5/2008; (10) Plaintiff may serve and file a reply directly rebutting the opposing party's response, and any objections to extrinsic evidence by 12/22/2008; (11) The Court will conduct a hearing on the issue of Claim Construction on 1/13/2009; (12) The parties shall complete fact discovery by 60 days after the Court issues its claim construction decision; (13) Each party shall make its initial expert witness disclosures, as required under Rule 26, on the issues on which each bears the burden of proof within 30 days of the close of fact discovery; (14) Each party shall make its initial expert witness disclosures, as required under Rule 26, on the issues on which the opposing party bears the burden of proof by 30 days after the first round of expert disclosures;(15) Rebuttal expert witness disclosures must be made by 10 calendar days after the second round of expert disclosures; (16) Expert depositions, if any, must be completed by 30 days after rebuttal expert disclosures are made; (17) Motions for summary judgment must comply with Local Rule 56.1 and must be filed within 30 days after the completion of discovery. Responses must comply with Local Rule 56.1 and must be filed within 30 days after the filing of the summary judgment motion. A reply brief may be filed within 10 calendar days of any responses; a Sur-reply brief may not be filed unless approved/requested by the Court; (18) Motions in limine and Daubert motion must be filed by a date to be set by the Court at the Post-Discovery Conference.
