ORDER: On April 15, 2014, the Court heard argument during a telephonic pre-motion conference concerning the following discovery pre-motion letters: 1. ORDER REGARDING CLASS CERTIFICATION BRIEFING AND DISCOVERY SCHEDULE: THEREFORE, IT IS HEREBY ORDERED: 1. For the reasons set forth within, Defendants motion to dismiss [dkt. no. 132] is GRANTED in part and DENIED in part. The result is as follows: Plaintiffs Sherman Act claims may proceed. The CD-purchaser class does not have antitrust standing, and its claims are DISMISSED with prejudice. The Court will conduct a standing inquiry on claims asserted in states in which no named plaintiff resides at the class certification stage. Defendants' motion to dismiss claims for violations of state consumer protection statutes is DENIED except as to New York, in which case it is GRANTED. Defendants' motion to dismiss the unjust enrichment claims is GRANTED in part and DENIED in part. Autonomous unjust enrichment claims are DISMISSED.
