STIPULATED ORDER Modifying the Court's Discovery Plan and Scheduling Order. Expert disclosures on issues for which a party bears the burden of proof will be due thirty (30) days after the latter of the close of fact discovery on January 27, 2012 or the date the Court issues a claim construction order. The Court inquires as to counsels' recent voluminous filings, as opposed to a request for a status conference with the Court as discussed at the 10/19/2011 hearing. The Court further addresses the recent conduct of Mr. McMillen and Mr. Hemminger. Mr. McMillen, on behalf of the Plaintiff, and Mr. Hemminger, on behalf of the Defendant, present arguments as to their respective positions regarding 74 Motion. The Court recites findings on the record as to each issue.IT IS ORDERED, 74 Motion is GRANTED in part and DENIED in part. IT IS FURTHER ORDERED, the fact Discovery Deadline is hereby continued to Friday, 1/27/2012. Counsel shall submit an Amended Stipulated Scheduling Order setting forth the revised fact discovery deadline no later than 12/12/2011. IT IS FURTHER ORDERED, such Amended Stipulated Scheduling Order shall also reflect a listing of the depositions to be rescheduled and extended beyond the District Judge's entry of the Marksman order and contain topic specifics identified with particularity as to the witnesses. Further, the depositions shall be limited to a maximum of six hours each. IT IS FURTHER ORDERED, in the event counsel desires to submit a draft Amended Stipulated Scheduling Order this week and participate in a telephonic status conference to finalize, counsel shall contact the Court. JUDGMENT. The Court HEREBY ORDERS, ADJUDGES, AND DECREES that: 1. Light Guards claim that all versions of the RS200 and RS320 infringe the 742 patent is dismissed with prejudice. 2. The Court enters judgment in favor of Spot Devices, Inc. for its declaratory judgment counterclaim of non-infringement, and declares that none of the versions of the RS200 and RS320 IRWLs at issue in this case infringe claims 1 - 15 of the 742 patent. 3. STIPULATED ORDER Modifying the Court's Discovery Plan and Scheduling Order. Expert disclosures on issues for which a party bears the burden of proof will be due thirty (30) days after the latter of the close of fact discovery on January 27, 201 2 or the date the Court issues a claim construction order.
