ORDER granting 176 Motion for Settlement; granting 179 Motion for Settlement. As set forth within, unless otherwise defined herein, all terms used in this Order will have the same meanings as defined in the Stipulation. The Court finds on a preliminary basis that the settlement memorialized in the Stipulation, filed with the Court, falls within the range of reasonableness and, therefore, meets the requirements for preliminary approval. The Court grants preliminary approval of the parties' Stipulation. The Court appoints, for settlement purposes only, Plaintiff Sylvester Cetina as representative of the New York Class. The Court appoints, for settlement purposes only, the following attorneys as "Class Counsel" for the New York Class: Seth R. Lesser and Fran Rudich of Klafter, Olsen & Lesser, LLP and Gregg I. Shavitz and Susan Stern of Shavitz Law Group, P.A. The Court approves Garden City Group ("GCG") as the Claims Administrator to perform duties in accordance with the Stipulation. The Court will conduct a Fairness Hearing on December 19, 2014 at 10:00 a.m. in Courtroom 905 of the Thurgood Marshall Courthouse for the purposes of: (a) making a final determination as to certification of the class pursuant to Rule 23 and of the fairness, adequacy, and reasonableness of the Settlement terms and procedures; (b) fixing the amount of attorneys' fees and litigation costs and expenses to Class Counsel and enhancement awards to Named Plaintiffs and Enhancement Award Plaintiffs; (c) hearing any timely and properly filed objections; and (d) entering Judgment. The Fairness Hearing may be continued without further notice to the New York Class Members and FLSA Collective Members. Plaintiffs shall file their motion for final approval of the settlement of the New York Class claims, and Class Counsel shall file their motion for attorneys' fees, litigation costs and expenses, and enhancement awards on or before December 5, 2014. ORDER: IT IS HEREBY ORDERED THAT Defendants' deposition of each opt-in shall be limited to five hours, without exception. As to the other issues, Defendants propose that any opt-in who is selected by the procedures agreed to by the parties shall be required to appear for a deposition, regardless of where they live. For an opt-in who does not wish to travel to New York, Defendants have offered to take the deposition by video-teleconference. Further, Defendants are willing to pay the video-teleconferencing costs for deponents who travel to one of Morgan Lewis' offices, but propose that Plaintiffs pay the costs associated with video-teleconferencing if an alternate location is used. Plaintiffs agree to the use of video-teleconferencing so long as the location is within fifty miles of the opt-in's residence. Plaintiffs do not propose a procedure if there is no video-teleconferencing location available within fifty miles nor do they make a proposal concerning who will pay for the video-teleconferencing. Nonetheless, the Court finds that Defendants' proposal is reasonable. Accordingly, IT IS FURTHER ORDERED THAT any opt in may choose to be deposed via video-teleconference instead of appearing in New York. Unless the parties agree otherwise, Defendants shall bear the video-teleconferencing costs for opt-ins deposed at a Morgan Lewis office and Plaintiffs shall bear the cost for opt-ins deposed at other locations. MEMORANDUM AND ORDER granting 54 Motion to Certify Class. For the foregoing reasons, and as stated on the record at the January 23, 2013 oral argument, the Court grants Plaintiffs' motion for conditional class certification and orders Defendants to produce to Plaintiffs, within twenty-one days, a list, in electronic format, of the names, e-mail addresses, work locations, and dates of employment of all persons employed by Defendants as CSAs in the last three years, exclusive of CSAs who work or worked in California. Accordingly, the Clerk of Court is respectfully directed to terminate the motion located at Doc. No. 54. In light of the Court's ruling and, as stated on the record at the January 23, 2013 conference, the parties are directed to submit, no later than February 8, 2013, either (1) their proposed class notice; or (2) if the parties still have remaining disagreements regarding that notice, a joint letter outlining their respective positions.
