ORDER as to Paul Ceglia. On or about March 6, 2015, Defendant Paul Ceglia cut off his electronic monitoring bracelet and left his home in violation of the conditions of his bail, and is presently a fugitive. At a conference on March 10, 2015, I granted the Government's application to revoke Ceglia's bail, and that same day issued an Order directing the co-signors of Ceglia's bond to appear for a hearing on March 24, 2015, to address the Government's motion seeking an order: (1) declaring forfeited the $250,000 personal recognizance bond executed by Ceglia; (2) entering a default judgment in the amount of $250,000 in favor of the United States of America against Ceglia; (3) entering a judgment in the amount of $250,000 in favor of the United States of America and against the co-signers Carmine Ceglia, Veronica Ceglia, and Brendan Ceglia jointly and severally; and (4) declaring forfeited the properties securing Ceglia's bond. After the hearing on March 24, 2015, I issued the Bail Forfeiture Order. (Doc. 160.) At the Governments request the Bail Forfeiture Order did not order the properties forfeited so that the Government could conduct further analysis on their value if forfeited. (Id.) Pursuant to my order of March 27, 2015, (Doc. 161), I directed that the Government provide me with regular status update letters every four-months. The record indicates that the most recent status update letter was filed December 29, 2015, (Doc. 180); therefore, the next status update is overdue. It is hereby, ORDERED that the Government file a status update letter on or before June 24, 2016. IT IS FURTHER ORDERED that the status update letter should include information related to the Bail Forfeiture Order, including (1) the results of the Government's analysis concerning the value of the properties subject to forfeiture and (2) the Government's efforts, if any, to collect on the amount of the bond from the co-singers. ORDER as to Paul Ceglia. Time excluded from 9/2/2015 until 1/4/2016. I am in receipt of the Governments status update letter of September 1, 2015. Pursuantto 18 U.S.C. § 3161(h)(3), the time within which a trial must commence is automatically excluded while the Defendants whereabouts are unknown and, in addition, he is attempting to avoid apprehension or prosecution or his whereabouts cannot be determined by due diligence. I have requested periodic status updates from the Government to keep informed concerning whether Defendants whereabouts remain unknown and cannot be determined by due diligence. In addition, in an abundance of caution, I also find that the time between September 2, 2015 and January 4, 2016 should be excluded under the Speedy Trial Act. This exclusion is necessary since Defendants absence continues to prevent defense counsel from consulting with his client and from preparing this case for trial. I am in receipt of a letter from counsel for Facebook, Inc. and Mark Elliot Zuckerberg, dated April 2, 2015, requesting modifications to my Order of March 30, 2015, (Doc. 165). In that Order, I ordered Facebook and Mr. Zuckerberg to promptly produce to defense counsel Robert Ross Fogg all production responsive to the previously issued Rule 17(c) subpoenas duces tecum, (Docs. 137, 138). ORDER as to Paul Ceglia. Before me is the Motion filed by walled-off Assistant United States Attorney Niketh Velamoor (the "Wall AUSA") on behalf of the Government for disclosure of documents withheld under a claim of privilege by certain former civil attorneys of Defendant Paul Ceglia ("Ceglia"). (Doc. 70.) For the reasons stated below, I conclude that most but not all of the documents whose disclosure the Government seeks fall within the crime-fraud exception to the attorney-client privilege.(See Footnote 1 on this Order). Accordingly, the Motion is GRANTED IN PART and DENIED IN PART. However, no documents may to be produced to the prosecution team at this time, and this Order may not be shared with the prosecution team at this time. As explained below, both Ceglia and the Wall AUSA will have one week to file any document-specific objections to my rulings below. After any such objections are finally resolved, the documents may be disclosed and this Order will be filed on the public docket....[See this Order]... IV. Conclusion: For the foregoing reasons, the Government's Motion, (Doc. 70), is GRANTED IN PART and DENIED IN PART. Specifically, the Motion is DENIED with respect to Documents 00027, 00028, 00047, 00071, 00080, 00125, 01946, 01950, 02060, 02148, 02446, 02447, 03084, 06263, 14788, 14797, 14806, 18083, 18693, 18696, 19088, 20064, 20073, 20543, 21660, 21665, 21689, 22684, 23581, and KAS326. The Motion is GRANTED with respect to all remaining documents contained in the Narrowed Set provided to the Court on February 6, 2015. All of the documents from the law firms in question have been available to the Wall AUSA and Ceglia's counsel for months. However, because all of the briefing and argument on this issue to date has been at a general level and has not addressed specific documents, I will give both parties an opportunity to offer any objections they may have to my rulings with respect to specific documents. By Monday, March 16, 2015, Ceglia and the Wall AUSA may file letter briefs of no more than five pages asserting any document-specific objections. Any letter briefs should be emailed directly to chambers and should not be filed on the public docket. This is not an opportunity for Ceglia to re-litigate Judge Carter's determination and my determination there is probable cause to conclude that his civil lawsuit lacked a factual or legal basis. Nor is it an opportunity for the Government to re-litigate Judge Carter's determination and my determination that not every document is within the crime-fraud exception simply because it was generated in connection with the allegedly baseless lawsuit. No opposition briefs will be permitted. If either party does not intend to file document-specific objections, or if either party believes I have inadvertently neglected to rule on any document within the Narrowed Set, they should so advise me as soon as possible. Until I resolve any objections, no documents may be disclosed to the prosecution team, and this Order shall not be filed on the public docket and may not be shared with the Ceglia prosecution team or with any other persons. I am taking these precautions to ensure that the substance of a potentially privileged document is not inadvertently disclosed to the Ceglia prosecution team or to anyone else until I have finally determined that the document is not privileged because it falls within the crime-fraud exception to the privilege. Ceglia's motion to strike the Government's reply, (Doc. 86), is denied, and the Clerk of Court is respectfully directed to terminate Doc. 86. The Government's letter motion, (Doc. 100), pertaining to Ceglia's motion to suppress the privileged documents on the basis of misuse of the grand jury subpoena power is moot, and the Clerk of Court is respectfully directed to terminate Doc. 100. ORDER as to Paul Ceglia. I previously filed an Order resolving the Government's motion for disclosure of documents withheld under a claim of privilege by some of Mr. Ceglia's former civil attorneys, (Doc. 70). The Order was temporarily filed under seal, (see Doc. 151), to allow both parties to offer document-specific objections to my rulings therein. The clerk of court is now directed to unseal this order. Mr. Ceglia's counsel identified two typographical errors in the Order. (Doc. 165.) The reference to Document 19025 on page 14 was intended to refer to Document 19031, and the reference to Document 18007 in footnote 7 was intended to refer to Document 18077. Through counsel's letter of March 19, 2015 and follow-up letter of March 24, 2015, Mr. Ceglia expressly reserved his position that the crime-fraud exception to the attorney-client privilege does not apply, but declined to offer any document-specific objections. The Wall AUSA, on behalf of the Government, objected to my ruling that Documents 00047 and 20064 were not within the crime-fraud exception. Upon due consideration, the Government's objection is SUSTAINED. Mr. Ceglia's email within Document 00047 is best understood as an effort to persuade his attorneys to continue representing him on the basis that the Facebook Contract, as that term is defined in my March 8, 2015 Order, was legitimate. That email therefore furthered Mr. Ceglia's allegedly fraudulent purpose. Mr. Ceglia's email in Document 20064 concerns, in part, the location of documents necessary to the conduct of the litigation and is therefore fundamentally similar to other communications on that subject between Mr. Ceglia and his attorneys whose disclosure I previously authorized. The Wall AUSA may now disclose to the prosecution team the documents whose disclosure I previously authorized in the sealed version of this Order, as well as Documents 00047 and 20064. My ruling that these documents may be disclosed does not constitute a ruling that any document will be admissible in evidence, in whole or in part, at trial. All rulings regarding the admissibility of any documents disclosed to the prosecution team are reserved for future proceedings. ORDER as to Paul Ceglia. I am in receipt of the Government's letter motion to hold production pursuant to Federal Rules of Criminal Procedure 16 and 17 in abeyance until Mr. Ceglia returns to the jurisdiction, (Doc. 162), and Mr. Ceglia's letter response, (Doc. 163). The Government shall promptly produce to Mr. Ceglia's counsel all Rule 16 discovery that: (1) is in its possession as of March 8, 2015, (2) has not already been produced, and (3) would not prejudice or disclose the details of its ongoing investigation into Mr. Ceglia's whereabouts. With respect to all discoverable materials that the Government has obtained or obtains after March 8, 2015, or that would prejudice its ongoing investigation into Mr. Ceglia's whereabouts, production pursuant to Rule 16 may be held in abeyance until Mr. Ceglia's return to the jurisdiction. I have broad discretion to defer Rule 16 discovery for good cause. See Fed. R. Crim. P. 16(d)(1); United States v. Delia, 944 F.2d 1010, 1018 (2d Cir. 1991); see also United States v. Rom, 528 F. App'x 24, 26 (2d Cir. 2013) (summary order). I find that Mr. Ceglia's flight and the integrity of the ongoing investigation into his whereabouts constitute good cause to defer ongoing Rule 16 production. In any event, I will ensure that Mr. Ceglia and his counsel have adequate time to review additional discovery prior to trial. Defense counsel's request for leave to submit further briefing on the applicability of the fugitive disentitlement doctrine is denied. Facebook, Inc., and Mark Elliot Zuckerberg shall promptly produce to defense counsel Robert Ross Fogg all production responsive to the previously issued Rule 17(c) subpoenas duces tecum, (see Docs. 137, 138), with any appropriate confidentiality designations under the Amended Protective Order. In addition to his obligations under the Amended Protective Order, Mr. Fogg shall not share the production or discuss its contents in any way with co-counsel Gil D. Messina until further order of the Court. This "wall" arrangement will be revisited upon Mr. Ceglia's return to the jurisdiction. This Order does not preclude the parties from agreeing to additional protocols related to this "wall" arrangement. In a separately filed order, I am authorizing the disclosure to the prosecution team of documents previously withheld by some of Mr. Ceglia's former civil attorneys under a claim of attorney-client privilege. Mr. Ceglia's counsel has requested leave to move for an order authorizing the issuance of additional Rule 17(c) subpoenas duces tecum pertaining to Mr. Zuckerberg's emails stored on Harvard University servers and Mr. Zuckerberg's computer hard drives. The request for leave is denied. This denial is without prejudice to the renewal of the request upon Mr. Ceglia's return to the jurisdiction. However, at this late stage, Mr. Ceglia must show good cause for the filing of additional substantive motions other than motions in limine, (see Doc. 135, at 49:1-12), and I note that counsel's letter failed to provide a justification for Mr. Ceglia's significant delay in making this request. ORDER as to Paul Ceglia. Subpoenas duces tecum were previously issued to Facebook, Inc. ("Facebook") and Mark Elliot Zuckerberg pursuant to Federal Rule of Criminal Procedure 17(c) with a return date of Monday, March 16, 2015 at 12:00 pm. (See Docs. 137, 138.) On March 8, 2015, the Court proposed an Amended Protective Order on Consent that would govern, inter alia, Facebook and Mr. Zuckerberg's production of documents pursuant to Rule 17(c). No interested party has expressed any objection to the Amended Protective Order. Counsel for Mr. Ceglia and counsel for Facebook and Mr. Zuckerberg shall sign the Amended Protective Order and return it to the Court to be entered as soon as possible. Facebook and Mr. Zuckerberg shall assemble and prepare all production responsive to the subpoenas, with any appropriate designations under the Amended Protective Order, by the return date. However, in light of Mr. Ceglia's nonappearance at today's conference and apparent flight, any production will be held in abeyance until further order of the Court. Facebook and Mr. Zuckerberg need not produce any responsive documents by the return date, but they should be prepared to produce all responsive documents immediately upon order of the Court at any time after the return date. The deadline for the Government and Mr. Ceglia to advise the Court via letter on ECF whether they intend to call Paul Argentieri as a witness, (see Doc. 143), is extended until Monday, March 16, 2015. Frey; and for good cause shown, WHEREAS, the Government is currently in possession of the document Paul Ceglia, the defendant, claims is the original, signed version of the contract between Paul Ceglia and Mark Zuckerberg (the "Contract"), which is the subject of dispute in this criminal action; WHEREAS, the Government desires to have the U.S. Postal Inspection Service National Forensic Laboratory (the "Laboratory") conduct non-destructive, observational testing of the Contract; and WHEREAS, the parties have conferred and have agreed that the Laboratory shall make arrangements to ensure that any testing of the Contract, all of which would occur when the Contract is removed from the protective covering in which the document was received by the Government, is videotaped and that a copy of that video recording shall thereafter be provided to counsel of record for Paul Ceglia, the defendant, in this criminal matter, together with the results of such testing; IT IS HEREBY ORDERED THAT the Laboratory shall videotape any and all inspections and/or testing of the Contract that it conducts from the time that the Contract is removed from its protective covering until the time that it is returned to its protective covering.
