Plaintiff's counsel reports that he has received Defendants Steel Equities and Steel-Los III's responses to the outstanding document requests and interrogatories in compliance with my Order of May 10, 2007. 2. Counsel for Third-Party Defendant and Counterclaimant Emery advised that certain information has come to light since our last conference indicating that the physical area at issue in this case was leased out to another company during the relevant time period. Once certain discovery is completed, Emery intends to file for summary judgment. Counsel for Defendants Steel Equities and Steel-Los III states that he will need certain information via deposition testimony before he is in a position on behalf of his client to determine whether to forego further prosecution of any claims against Emery. That judgment should be made expeditiously. 3. The parties are reminded, as set forth in my Individual Rules and the Case Management and Scheduling Order previously entered, that not less than two business days before the Pre-Trial conference, each party must submit by mail or fax (not by ECF) a one-page, ex parte statement of its settlement position. SCHEDULING: A telephone status conference will be held on May 29, 2007 at 11 a.m. THE FOLLOWING RULINGS WERE MADE: 1. Plaintiff's counsel reports that Defendant Steel Equities still has not responded to interrogatories and document requests which were served in January, some four months ago. Therefore, I have advised counsel for Steel Equities that I am directing his clients by this Order to provide all responses to the document requests and interrogatories. In light of the intervening time and the failure to file any objections to such demands, all objections are hereby waived and the demands are to be responded to fully and completely. Should Defendants Steel Equities Inc. And /or Steel-Los III fail to comply with this Order, I shall schedule a hearing for the purpose of determining whether these entities shall be held in contempt of the Court's Order. 2. Plaintiff and Defendant Steel Equities have entered into a Stipulation concerning Plaintiff's jury demand. I have directed Plaintiff's counsel to have the Stipulation filed on ECF. Once the Stipulation is filed on ECF, I will take the appropriate action and will then forward the original to the Clerk's Office. 3. Counsel for Emery Worldwide Airlines, Inc. reports that the company ceased operations in January 2001 and that there is no witness available to testify in this case. Counsel also notes that Emery left the premises at issue more than 1 years prior to the incident giving rise to this case. Since Defendant Steel Equities brought this third-party action, it is left to Steel Equities to determine what relief, if any, they seek against Emery Worldwide at this juncture. 4. Plaintiff's counsel states that there will be a medical expert produced in this case. I have cautioned Plaintiff's counsel that all expert information required by Rule 26, including the expert report, must be served upon Defendants' counsel no later than 30 days prior to the deadline for discovery in this case, which is August 16, 2007, to enable Defendants to produce their own rebuttal experts should they choose to do so.SEE ATTACHED ORDER FOR ADDITIONAL RULINGS AND INFORMATION.
