ENDORSED ORDER: Plaintiff's Motion for Leave to Identify Defendant by Name 11 is denied without prejudice for failure to state whether it complied with the terms set forth in the Order issued by United States Magistrate Judge Thomas B. McCoun III on March 13, 2013. Plaintiff claims that Defendant's internet service provider provided Plaintiff with Defendant's identifying information on May 6, 2013, and that "On May 17, 2013... Plaintiff notified Defendant of its intent to name Defendant in its Amended Complaint...." 11 . However, in the Court's Order on March 13, 2013, Judge McCoun held that "Plaintiff shall provide a copy of this Order to the individual(s) identified by the ISP within five days of receipt of such information." 7 at 4. Judge McCoun also held that "On the initial contact with the Doe Defendant, Plaintiff shall inform the Doe Defendant or counsel that it is acting pursuant to court order which the Doe Defendant may contest if he or she wishes. Plaintiff shall also notify the Doe Defendant that he or she has the right to obtain legal counsel to represent him or her in this matter and that anything said or provided by the Doe Defendant can be used against him or her in this proceeding." Id. at 4-5. In the instant Motion, Plaintiff fails to state if it provided Defendant with the information specified in the March 13, 2013, Order. Plaintiff also fails to specify whether it contacted Defendant within five days of receipt of Defendant's identifying information, as directed by the Court, or if Plaintiff's initial contact with Defendant occurred on May 17, 2013.
