   AIThe Wikimedia Foundation, joined by eight other organizations including Human Rights Watch, Amnesty International USA, the ACLU, PEN America, The Nation magazine, and several other civil liberties and journalism groups, filed this lawsuit in March 2015 in the District of Maryland challenging the NSA's "Upstream" surveillance program — one of the mass surveillance programs revealed by Edward Snowden's disclosures in 2013. Upstream collection involves the NSA copying and searching internet communications as they travel across the fiber-optic backbone of the internet, including through the facilities of major telecommunications providers. The plaintiffs argued that Upstream surveillance violated the First and Fourth Amendments by intercepting and searching their international communications without warrants or individualized suspicion. Wikimedia contended it had standing to sue because the NSA's collection inevitably intercepted communications between Wikimedia's servers in the United States and its millions of international users, given the massive scale of Upstream's reach. The government disputed that standing existed, arguing plaintiffs could not establish their communications had been collected. The Fourth Circuit ruled in 2017 that Wikimedia had adequately alleged standing based on the scale of its international internet traffic, allowing the case to proceed. However, the case was ultimately dismissed on state secrets grounds — the government successfully argued that further litigation would require disclosing classified information that could not be revealed even to a court.
